PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>[1]\t\tHeard<br \/>\nMr.Thakore, learned advocate for the applicant appearing through<br \/>\nlegal aid and Mr.Poojari, learned APP for the respondent &#8211;<br \/>\nState.\n<\/p>\n<p>[2]\t\tPresent<br \/>\napplication is filed by the applicant for releasing him on bail.<br \/>\nApplicant is convicted by the learned Additional Sessions \/ Special<br \/>\nJudge, Banaskantha, Palanpur on 30.08.2011 in Sessions Case No.72 of<br \/>\n2010 for the offence punishable under section 135(1)(A) of the<br \/>\nElectricity Act, 2003.  For the said offence, applicant was sentence<br \/>\nto suffer six months rigorous imprisonment and to pay fine of<br \/>\nRs.27,474\/- and in default of payment, further two months simple<br \/>\nimprisonment.\n<\/p>\n<p>[3]\t\tIt<br \/>\nis submitted by learned advocate for the applicant that initially<br \/>\nwhen complaint was lodged, applicant remained in jail for 27 days. It<br \/>\nis also submitted that from the date of judgment i.e. 30.08.2011 the<br \/>\napplicant is in jail.\n<\/p>\n<p>[4]\t\tConsidering<br \/>\nthe nature of offence and considering the period for which applicant<br \/>\nremained in jail, present application is allowed.\n<\/p>\n<p>[5]\t\tApplicant\n<\/p>\n<p> &#8211; accused is ordered to be released on bail on executing personal<br \/>\nbond of Rs.5000\/- (Rupees Five Thousand only) with one surety of the<br \/>\nlike amount before the Trial Court on condition that he shall not<br \/>\nleave India without prior permission of the Court.
