S.J. MUKHOPADHAYA)<\/p>\n<p>\tIt<br \/>\nappears that the Liquidator fixed the priority.  The same was<br \/>\nchallenged and the learned Single Judge by order dated 23\/26.02.2010<br \/>\ndecided the priority in which the amount to be released in favour of<br \/>\none or the other creditors.  Being unhappy, the present appeals have<br \/>\nbeen preferred by all the creditors against the priority as fixed by<br \/>\nthe learned Single Judge.\n<\/p>\n<p>\tOne<br \/>\nof the issue relates to priority of DICGC.  It is informed that such<br \/>\nissue has been decided by different High Courts and 18 S.L.Ps. have<br \/>\nbeen already been preferred and pending before the Supreme Court in<br \/>\nCivil Appeal No.1035 of 2008, etc.  The said Appeals were earlier<br \/>\nfixed for hearing in August 2010 and some other date of hearing may<br \/>\nbe fixed.  In the facts and circumstances, we adjourn the case.<br \/>\nParties are given liberty to inform the status of the pending appeals<br \/>\n where one of the issue is similar.
