Justice P.N.RAVINDRAN\n\n Dated :23\/06\/2009\n\n O R D E R\n                           P.N.RAVINDRAN, J.\n                      -------------------------------------\n                       W.P.(C)No.13947 of 2009\n                     --------------------------------------\n                          Dated 23rd June, 2009\n\n                                JUDGMENT\n<\/pre>\n<p>               Heard   Sri.U.Balagangadharan,            the learned counsel<\/p>\n<p>appearing for the petitioner and Smt.Anu Sivaraman, the learned<\/p>\n<p>Government Pleader appearing for the respondents.<\/p>\n<p>             2. The petitioner is a pensioner. He retired from service on<\/p>\n<p>30.9.2004 while working as Assistant Sub Inspector of Police at<\/p>\n<p>Malampuzha. In this writ petition, the petitioner&#8217;s grievance is that<\/p>\n<p>though the terminal benefits have been disbursed to him, the amounts<\/p>\n<p>due under the Family Benefit Scheme have not so far been disbursed.<\/p>\n<p>As directed by this Court, the third respondent has filed a statement<\/p>\n<p>dated 16.6.2009 explaining the delay in payment of amounts payable<\/p>\n<p>to the petitioner under the Family Benefit Scheme. Paragraphs 2 and 3<\/p>\n<p>of the said statement read as follows:\n<\/p>\n<blockquote><p>                 &#8220;2. In this case, the petitioner entered into<br \/>\n          service on 01.04.1968.            While working in this<br \/>\n          District, he was transferred to Vigilance Unit and<br \/>\n          relieved from this District on 07.10.1979, and<br \/>\n          received back from Vigilance and Anti Corruption<br \/>\n          Bureau, to Palakkad District during 10\/83.              His<br \/>\n          consolidated Family Benefit Scheme account had<br \/>\n          already transferred to Vigilance Department.            The<br \/>\n          Family Benefit Scheme consolidated account in<br \/>\n          respect of the petitioner up to 10\/83 has been<br \/>\n          forwarded to this office by Vigilance Department.<br \/>\n          Further, he was transferred to CB CID during<\/p>\n<p><span class=\"hidden_text\">WP(C).No.13947\/2009                2<\/span><\/p>\n<p>          01.11.1986 till 01\/95.    Later, his Family Benefit<br \/>\n          Scheme account up to 10\/86 was sent to Additional<br \/>\n          Director     General      of     Police,      Crimes,<br \/>\n          Thiruvananthapuram.     Again, he was received on<br \/>\n          transfer from CBCID to Palakkad District and<br \/>\n          reported during 02\/1995.        His Family Benefit<br \/>\n          Scheme consolidated up to 01\/1995 was received<br \/>\n          from Additional Director General of Police, Crimes,<br \/>\n          Thiruvananthapuram. Later, he was transferred to<br \/>\n          CBCID unit and worked there from 01\/1996 to<br \/>\n          06\/2002. His Family Benefit Scheme consolidated<br \/>\n          account up to 12\/1995 has been forwarded to the<br \/>\n          Additional     Director    of     Police,     Crimes,<br \/>\n          Thiruvananthapuram.       Later,   his   consolidated<br \/>\n          account of Family Benefit Scheme up to 06\/2002<br \/>\n          was received from the Additional Director General of<br \/>\n          Police, Crimes,    Thiruvananthapuram.       Director<br \/>\n          General of Police, Kerala, Thiruvananthapuram had<br \/>\n          also reminded the Director, Vigilance and Anti<br \/>\n          Corruption    Bureau,     Thiruvananthapuram      on<br \/>\n          03.06.2009 for furnishing the statement.\n<\/p><\/blockquote>\n<blockquote><p>                      3. As per Government Circular No.30\/90<br \/>\n          Fin. Dated 04.05.1990, his month-war Family<br \/>\n          Benefit Scheme deduction statement are to be<br \/>\n          obtained   from   the   concerned    units   for the<br \/>\n          preparation of his Family Benefit Scheme statement<br \/>\n          for forwarding the same to Government for final<br \/>\n          settlement. His month-war deduction statement for<br \/>\n          the period from 10\/1979 to 02\/1981 and 04\/1983 to<br \/>\n          10\/1983 has not been received so far from the<br \/>\n          Director, Vigilance and Anti Corruption Bureau,<br \/>\n          Thiruvananthapuram, despite repeated reminders.<br \/>\n          The   month-war     deduction   statement    will be<br \/>\n          forwarded to Government for sanctioning his Family<br \/>\n          Benefit Scheme final statement without further<br \/>\n          delay, on receipt of the same from the Director,<br \/>\n          Vigilance    and     Anti     Corruption      Bureau,<br \/>\n          Thiruvananthapuram.       The   Writ   Petition  may<br \/>\n          therefore be disposed of.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WP(C).No.13947\/2009                3<\/span><\/p>\n<p>In my opinion, the respondents have given adequate explanation for<\/p>\n<p>the delay in disbursement of the amount due to the petitioner under<\/p>\n<p>the Family Benefit Scheme.     The statement also discloses that the<\/p>\n<p>respondents are taking steps to disburse the amounts due to the<\/p>\n<p>petitioner under the Family Benefit Scheme.\n<\/p>\n<p>            In such circumstances, I dispose of this writ petition with a<\/p>\n<p>direction to the Director of Vigilance and Anti Corruption Bureau to<\/p>\n<p>forward the deduction statement for the period from 10\/1979 to<\/p>\n<p>02\/1981 and for the period from 04\/1983 to 10\/1983 to the<\/p>\n<p>Superintendent of Police, Palakkad, for onward transmission to the<\/p>\n<p>Government within one month from the date on which the petitioner<\/p>\n<p>produces a certified copy of this judgment before him. The<\/p>\n<p>Superintendent of Police, Palakkad shall on receipt of the statement<\/p>\n<p>from the Director of Vigilance and Anti Corruption Bureau forward the<\/p>\n<p>same to the Government within two weeks thereafter, together with<\/p>\n<p>the connected records. The Government shall within one month from<\/p>\n<p>the date of receipt of the records from the Superintendent of Police,<\/p>\n<p>Palakkad pass orders according sanction for payment of the amounts<\/p>\n<p>due to the petitioner under the Family Benefit Scheme.
