\nof the Protection of Womenvfi’oV.ri1_ Violence Act {‘Act’ for<\/p>\n

it  __qr11.’esAti;0n’Air1 Criminal Appeai. The appellate court modi\ufb01ed the<\/p>\n
order. instead of Rs.-4,00(‘)\/– maintenance to the respondent<\/p>\n
No.1, it is reduced to Rs.3,000\/- and similarly it is reduced to
\nRs.3,000\/– to respondent No.2 also. As against this order,___the<\/p>\n
petitioner has filed this revision petition.<\/p>\n
3. Learned Counsel appearing for the petitionerj”~  V’
\nsubmitted that, the shared household  by
\napplication is an exclusive property
\npetitioner and such house canno:t~l..Vbe lltiejatedu
\nhousehold under the de\ufb01nition of  ‘2,c1ause’  ofithe Act.<\/p>\n
In support of his contentionllhe   decision of the
\nApex Court reported_:1n.V_.VOlC:i-.’I’   AIR 2007 SC
\n3318 in the   ANOTHER –vs–\n<\/p>\n
SMT.TARU1\\lA___vBAflT<iii;::v_ _an'._c1-  that, in identical
\ncircumstances'; the  observed as under:\n<\/p>\n
“29. As reglar.ds’Sectionp 17(1) of the Act, in our opinion<\/p>\n
the wife isonly entitied “to claim a right to residence in
\nashared household, and a ‘shared household’ would
\n only mean the  belonging to or taken on rent by
\n.  husband, or the house which belongs to the joint
\n “‘_farnily\u00ab._hof Vlwhigrh the husband is a member. The
\n‘ . propei’ty_~vin question in the present case neither belongs
\nto Amit Baird nor was it taken on rent by him nor is it a
\njoint fanny property of which the husband Amit Batra<\/p>\n
is a~~merr1ber. It is the exclusive property of appellant<\/p>\n
   A. .No.2,’mother of Amit Baird Hence it cannot be called a<\/p>\n
 _ ‘shared household.”\n<\/p>\n

4. In this case, it is not in dispute that the shared
\nhousehold mentioned by the complainant is the property
\nstanding in the name of rnother–in–laW of respondent No:.l;
\nit is neither standing in her husband’s name nor  .
\nproperty nor was it a joint family property,’  xrieiif  ” ”
\nI find that the judgment of the Apex
\nSection 17 of the Act squarely appiies_yto this lcasg     if<\/p>\n
5. Insofar as monetary benefitli_lis-l.conceI’hedl,:  appellate
\ncourt taking into consideration   iyciivcurpnstances has fixed
\nthe reasonable monetary  justification to<\/p>\n
interfere with they saidgee\ufb01nding.\n<\/p>\n
Accordingly, the  partly allowed. Insofar as<\/p>\n
shared h-o.useho1d_:l is..v”con-cerned, the order of the learned<\/p>\n
{Magistilate iii. CrLMisc.l\\?o’;7v94\/2008 dated 27.6.2009 con\ufb01rmed<\/p>\n
in’Qi’inji11a;l”\u00ab..g\u00a7ppeall_;.No.565\/2009 dated 31st March 2010 is<\/p>\n
 mhereby   “The order of monetary benefit as ordered by<\/p>\n
-.l.l.”_f:..\u00abthe,learnedlviagistrate modified by the learned Sessions Judge<\/p>\n
 \u00ab.i_s”Whereb’y con\ufb01rmed. However, liberty is reserved to the<\/p>\n
 respogndents to seek such other alternative accommodation as<\/p>\n
pennissible in law. If any such application is filed by the<\/p>\n
respondents, the Eearned Magistrate is directed to dispose of the<\/p>\n
same as early as possible.\n<\/p>\n
