Jain, learned counsel for the petitioner.\n      Shri Puneet Shroti, Panel Lawyer for the State.\n\n      Challenging the order annexure P-2 dated 22\/02\/05 by\nwhich promotion of the petitioner ordered earlier vide\nannexure P-1 dated 24\/09\/04 is cancelled, petitioner has filed\nthis writ petition.\n\n2.    It is the case of the petitioner that on the basis of\nDepartmental      Promotion   Committees      recommendation,\npetitioner, who was a Class IVth employee, was promoted as\nan Asst. Grade-III on 24\/09\/04 in the post reserved for\nScheduled Caste Candidates. However, the promotion is\ncancelled without notice to the petitioner, without indicating\nany reason and without granting any opportunity of hearing.\nAccordingly, petitioner has filed this writ petition challenging\nthe order annexure P-2 dated 22\/02\/05, cancelling promotion\nof the petitioner.\n\n3.    Even though notices have been issued and the matter is\npending since 2005, respondents have not filed any reply.<\/pre>\n<p>4.    As learned counsel for the petitioner objected to grant<br \/>\nany further time and there was no justification on the part of<br \/>\nthe respondents in not filing the reply, even though more than<br \/>\n<span class=\"hidden_text\">                                                                 2<\/span><\/p>\n<p>5 years have passed, matter is being heard and decided on the<br \/>\nbasis of material available on record.\n<\/p>\n<p>5.    It is clear from the records that vide order annexure P-1<br \/>\ndated 24\/09\/04, petitioner who was working as Class-IVth<br \/>\n(Peon), was promoted in the clerical cadre as Asst. Grade-III,<br \/>\nthe promotion was on the post reserved for Scheduled Caste<br \/>\ncandidate and while so working the order of promotion of the<br \/>\npetitioner is cancelled vide annexure P-2 on 22\/02\/05,<br \/>\npetitioner has only challenged promotion on the ground that<br \/>\nthe order of promotion granted is cancelled without notice to<br \/>\nthe petitioner, without hearing him and without disclosing<br \/>\nany reason.\n<\/p>\n<p>6.    Shri Puneet Shroti, learned counsel for the State<br \/>\nGovernment by taking me through the reasons indicated in<br \/>\nthe impugned order annexure P-2 dated 22\/02\/05 argued that<br \/>\npromotion of the petitioner has been cancelled because when<br \/>\nthe proceedings of the DPC was reviewed, it was found that<br \/>\nthe seniority of the petitioner was incorrectly reflected and, as<br \/>\na result, he has been granted promotion, even though he did<br \/>\nnot fall within the zone of consideration. It was also found<br \/>\nthat as per rules the promotion is to be granted only to such of<br \/>\nthe Scheduled Caste Employees, who were working on the<br \/>\ncut off date i.e. 6\/9\/92, petitioner is working as Peon, from<br \/>\n14\/09\/92 and, therefore, he did not come within the zone of<br \/>\nconsideration. Accordingly, pointing out that the petitioner<br \/>\n<span class=\"hidden_text\">                                                                3<\/span><\/p>\n<p>was not entitled for promotion, respondents contend that the<br \/>\nmistake is corrected by the impugned order, this contention<br \/>\nhas not been refuted by the petitioner.\n<\/p>\n<p>7.    Having heard learned counsel for the parties and on<br \/>\nconsideration of the fact that has come on record, it is true<br \/>\nthat in the impugned order annexure P-2, dated 22\/02\/05,<br \/>\nvarious reasons are given for cancelling order of promotion,<br \/>\nexcept for contending that petitioner is not heard, petitioner is<br \/>\nunable to demonstrate before this Court as to how the reasons<br \/>\nindicated in annexure P-2 for cancelling promotion of the<br \/>\npetitioner is unsustainable. Merely because petitioner is not<br \/>\nheard, that by itself is not a ground for interfering in the<br \/>\nmatter, when in the impugned order detailed reasons are<br \/>\ngiven for canceling promotion of the petitioner. That being<br \/>\nso, petitioner has to prima facie demonstrate before this court<br \/>\nthat the reason given for cancelling the promotion, as<br \/>\ncontained in the impugned order is unsustainable, petitioner<br \/>\nhaving failed to demonstrate prejudice case, or in challenging<br \/>\nthe reasons, merely on the ground that petitioner has not been<br \/>\nheard, it is not a fit case where interference can be made by<br \/>\nthis Court, more so when the order cancelling the promotion<br \/>\nhas been given effect to more than 5 years back and petitioner<br \/>\nis working on the reverted post for all this period.\n<\/p>\n<p>8.    Accordingly, for the present, finding no case for<br \/>\ninterference on the ground raised, liberty is granted to the<br \/>\n<span class=\"hidden_text\">                                                             4<\/span><\/p>\n<p>petitioner to challenge the order annexure P-2 dated 22\/02\/05<br \/>\nby representing or filing an appeal to respondent Nos. 1 &amp; 2<br \/>\nand it is upto respondent Nos.1 &amp; 2 to consider claim of the<br \/>\npetitioner and decide it by a speaking order in accordance to<br \/>\nlaw at an earlier date.\n<\/p>\n<p>9.
