SANKARAN, J.\n                     ---------------------------\n                     B.A. No. 5117 of 2009\n                 ------------------------------------\n           Dated this the 14th day of September, 2009\n\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure.          The petitioners are<\/p>\n<p>accused Nos. 2 and 3 in Crime No.171\/2009 of Mavoor Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 454 and 380 read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<p>     3.    The first accused is the husband of the defacto<\/p>\n<p>complainant. Accused No. 2 is the person who entered into an<\/p>\n<p>agreement for sale with the first accused. Third accused is the<\/p>\n<p>helper of the second accused and a witness to the agreement. It<\/p>\n<p>would appear that the first accused and his wife, the defacto<\/p>\n<p>complainant, are on logger heads and there are litigations<\/p>\n<p>between them.\n<\/p>\n<p>     4. Heard the learned counsel for the petitioner and the<\/p>\n<p>learned Public Prosecutor. I have also perused the Case Diary.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5117 of 2009                 2<\/span><\/p>\n<p>      4.    Taking into account the facts and circumstances of<\/p>\n<p>the case, the nature of the offence and other circumstances, I<\/p>\n<p>am of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police<\/p>\n<p>station shall release them on bail on their executing bond for Rs.<\/p>\n<p>25,000\/- each with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>         A) The petitioners       shall   report  before    the<br \/>\n            investigating     officer  between 9 A.M and 11<br \/>\n            A.M. on all alternate Mondays, till the final report<br \/>\n            is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The    petitioners     shall  appear  before    the<br \/>\n            investigating officer for interrogation as and<br \/>\n            when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n            prosecution witnesses or tamper with the<br \/>\n            evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         E) In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 5117 of 2009            3<\/span><\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                  K.T.
