Through Secy.Dept.Of Basic Edu.Lko.And Ors.\nPetitioner Counsel :- M.P.Yadav\nRespondent Counsel :- C.S.C.,Jogendra Nath Verma\n\nHon'ble Rajiv Sharma,J.\n<\/pre>\n<p>Heard learned Counsel for the petitioners and learned Standing<br \/>\nCounsel.\n<\/p>\n<p>By means of the instant writ petition, the petitioner prays for a writ in the<br \/>\nnature of Mandamus commanding the opposite parties to consider the<br \/>\ncase of the petitioner for grant-in-aid to the Junior HIgh School i.e. for<br \/>\nClasses 6 to 8 in the light of the judgment and order passed by the<br \/>\nSingle Judge in Civil Misc. Writ Petition No. 61343 of 2006. Further it<br \/>\nhas been prayed that the benefit of the order dated 4.1.2007 passed by<br \/>\nthe Single Judge in Civil Misc. Writ Petition No. 61343 of 2006 affirmed<br \/>\nby the Division Bench in Special Appeal No. 162 of 2007 and also<br \/>\naffirmed by the Apex Court ivide judgment dated 2.12.2009.\n<\/p>\n<p>Learned Counsel for the petitioner submits that Government Order<br \/>\ndated 7.9.2006 was challenged in writ petition No. 61343 of 2006<br \/>\n:Committee of Management Mata Tapeshwari Saraswati Vidya Mandir<br \/>\nVersus State of U.P. and others and this Court at Allahabad was<br \/>\npleased to quash the condition No. 2 (13) of the Government Order<br \/>\ndated 7.9.2006. The relevant part of the order dated 4.1.2007 reads as<br \/>\nunder :\n<\/p>\n<p>&#8220;Accordingly, this writ petition is allowed and condition no. 2 (13) of the<br \/>\nGovernment Order dated 7.9.2006 issued by the State Government as<br \/>\nwell as condition No. 12 of the advertisement dated 9.9.2006 issued by<br \/>\nthe Directorate of Basic Education, U.P. are quashed. The respondent<br \/>\nauthorities are directed to consider the petitioners institution (along with<br \/>\nthe other applicants) for their Junior High School Section being brought<br \/>\non grant-in-aid in pursuance of the Government Order dated 7.9.2006,<br \/>\nignoring the aforesaid conditions of the Government Order and the<br \/>\nadvertisement&#8221;\n<\/p>\n<p>Learned Counsel for the petitioner submits that the aforesaid order<br \/>\ndated 4.1.2007 was challenged in Special Appeal No. 162 of 2007<br \/>\n :State of U.P. and others Vs. Committee of Management Mata<br \/>\nTapeshwari Saraswati Vidya Mandir and a Division Bench of this Court<br \/>\nat Allahabad, vide judgment and order dated 15.1.2008, dismissed the<br \/>\nspecial appeal. Feeling aggrieved, the State of U.P. preferred special<br \/>\nleave petition before the Hon&#8217;ble Supreme Court, which was numbered<br \/>\nas Special Leave Petition (C) No. 4630 of 2008 :State of U.P. Vs.<br \/>\nCommittee of Management, Mata Tapeshwari Saraswati Vidya Mandir<br \/>\nand others. Initially, Hon&#8217;ble Supreme Court, while issuing notices,<br \/>\ndirected the parties to maintain status quo but finally, Hon&#8217;ble Supreme<br \/>\nCourt, vide judgment and order dated 2.12.2009, dismissed the special<br \/>\nleave petition. The relevant part of the order dated 2.12.2009 reads as<br \/>\nunder :\n<\/p>\n<p>&#8220;These special leave petitions are, accordingly, dismissed. As directed<br \/>\nby the learned Single Jude of the High Court by his judgment and order<br \/>\ndated 4th January, 2007 and upheld by the Division Bench by its<br \/>\njudgment and order dated 15th January, 2008, the petitioners are<br \/>\ndirected to consider the case of the respondent institutions, along with<br \/>\nother applicants, for being brought within the ambit of the grant-in-aid<br \/>\nScheme in pursuance of the Government Order dated 7th September,<br \/>\n2006, and while doing so ignore Condition No. 2 (13) of the said order<br \/>\nand Condition No. 12 of the Advertisement dated 9th September, 2006,<br \/>\nissued by the Directorate of Basic Education, U.P.&#8221;\n<\/p>\n<p>Learned Counsel for the petitioner submits that the case of the petitioner<br \/>\nis identical to that of the aforesaid case and as such, interest of justice<br \/>\nwould suffice, if the opposite parties are directed to consider the case of<br \/>\nthe petitioner in terms of the order and judgment dated 2.12.2009<br \/>\npassed by the Hon&#8217;ble Supreme Court, to which learned Standing<br \/>\nCounsel did not dispute.\n<\/p>\n<p>In view of the above, the writ petition is disposed of finally with a<br \/>\ndirection to the opposite parties to consider the case of the petitioner in<br \/>\nterms of the order and judgment dated 2.12.2009 passed by Hon&#8217;ble<br \/>\nSupreme Court in Special Leave Petition (C) No. 4630 of 2008 : State of<br \/>\nU.P. Vs.
