Justice V.GIRI\n\n Dated :02\/07\/2008\n\n O R D E R\n                              V.GIRI,J.\n                       -------------------------\n                  W.P ( C) No.13032 of 2008\n                       --------------------------\n                 Dated this the 2nd July, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioners retired as Nursing Superintendent Gr.II<\/p>\n<p>on 28.2.2007. They were aspiring for promotion to the<\/p>\n<p>post of Nursing Superintendent Gr.I.                 Apparently,<\/p>\n<p>according to them, though they were enough vacancies<\/p>\n<p>they were not promoted and the vacancies were kept<\/p>\n<p>unfilled. Their request for provisional promotion was also<\/p>\n<p>not considered. In Exhibit P9 judgment, this court had<\/p>\n<p>directed the petitioners claim for promotion with<\/p>\n<p>reference to the date of occurrence of the vacancies to be<\/p>\n<p>considered. It has been so held in Exhibit P9:<\/p>\n<p>                  &#8220;Now the petitioners have         retired<br \/>\n            from service on 28.2.2007.          Petitioner&#8217;s<br \/>\n            claim under Exhibit-P8 can only be<br \/>\n            considered as one for notional promotion<br \/>\n            with reference to the date on which the<br \/>\n            vacancy arose.\n<\/p>\n<p>                  After having heard the learned<br \/>\n            Government      Pleader     also,    this  writ<br \/>\n            petition is disposed of directing the 1st<br \/>\n            respondent     to    look    into    Exhibit-P8<br \/>\n            representation and after hearing the<br \/>\n            petitioners take a decision thereon within<\/p>\n<p>W.P ( C) No.13032 of 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>             three months from the date of receipt of a<br \/>\n             copy of this judgment untrammeled by<br \/>\n             Exhibit-P7.\n<\/p>\n<p>      2.     Pursuant    to   Exhibit P9,  Government     has<\/p>\n<p>considered the petitioners case       and rejected it under<\/p>\n<p>Exhibit P10. Paragraph 3 of the same reads as follows:<\/p>\n<blockquote><p>             &#8220;3. Government have examined the matter<br \/>\n       in detail. In the absence of Special Rules and<br \/>\n       finalised seniority list in the cadre of Nursing<br \/>\n       Superintendent Gr.II, provisional promotions are<br \/>\n       being resorted only to meet the exigencies for<br \/>\n       filling up the vacancies at the earliest. At the<br \/>\n       time of their retirement, they were working in<br \/>\n       Kozhikode District as Nursing Superintendent<br \/>\n       Gr.II and the proposal for provisional promotion<br \/>\n       from Director of Health Services received only<br \/>\n       on 19.3.2007. Since the petitioners retired from<br \/>\n       service on 28.2.2007, they were not included in<br \/>\n       the proposal. As such the petitioner&#8217;s request<br \/>\n       for promotion on the date of occurrence of<br \/>\n       vacancies for which they were eligible cannot be<br \/>\n       granted. Hence their request is rejected.<\/p><\/blockquote>\n<p>      3.     It is obvious that Government has not understood<\/p>\n<p>the directions contained in Exhibit P9 judgment. This Court<\/p>\n<p>was aware of the fact that petitioners claim for promotion<\/p>\n<p>to the post of Nursing Superintendent Gr.I could be<\/p>\n<p>considered as only a claim for notional promotion in<\/p>\n<p>circumstances where they had already retired from service<\/p>\n<p>W.P ( C) No.13032 of 2008<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>on 28.2.2007. But nevertheless Government was directed<\/p>\n<p>to consider their claim for promotion with reference to the<\/p>\n<p>date of occurrence of the vacancies. This was after taking<\/p>\n<p>note of fact that they had already retired from service.<\/p>\n<p>Their claim was rejected under Exhibit P10 on the premise<\/p>\n<p>that petitioners had already retired from service on<\/p>\n<p>28.2.2007 and proposal for promotion was received only on<\/p>\n<p>19.3.2008. In my view, there is obvious non-application of<\/p>\n<p>mind.\n<\/p>\n<p>      In the result, Exhibit P10 is set aside and the<\/p>\n<p>Government is directed to pass fresh order in terms of the<\/p>\n<p>directions already issued in Exhibit P9 judgment.
