SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/11\/2008 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\nmatter is called out in the First Session, learned Counsel for the<br \/>\npetitioners was absent, therefore, it was kept back. Again when it is<br \/>\ntaken up on Second call, learned Counsel for the petitioners is<br \/>\nabsent. This matter is placed on Board of Regular Admission and<br \/>\ntherefore, this Court has no other alternative but to proceed with<br \/>\nthe matter ex-parte.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of these petitions under Article 227 of the Constitution of<br \/>\nIndia, the petitioners ?  original plaintiffs have prayed for an<br \/>\nappropriate Writ, direction and\/or order quashing and setting aside<br \/>\nthe impugned order dated 08.06.2007 passed by the learned Additional<br \/>\nDistrict Judge, Jamnagar in Appeal No.31 of 2007 as well as order<br \/>\ndated 21.04.2007 passed by the learned Civil Judge (SD), Jodiya in<br \/>\nRegular Civil Suit No.199 of 2006 in refusing to grant interim<br \/>\ninjunction during the pendency of Regular Civil Suit No.199 of 2006.\n<\/p>\n<p>3.\t\tAt<br \/>\nthe outset, it is required to be noted that atleast since 08.06.2007<br \/>\nthere is no relief in favour of the petitioners. It appears from the<br \/>\nproceedings and the impugned order that all the petitioners are<br \/>\nencroachers who have encroached upon Gauchar land and have put up<br \/>\nillegal construction and notice came to be issued by the Panchayat in<br \/>\naccordance with the provisions of the Gujarat Panchayat Act and at<br \/>\nthat stage the plaintiffs instituted aforesaid Suit and prayed for<br \/>\ninjunction and both the Courts have concurrently found against the<br \/>\npetitioners that there is no prima-facie case in favour of the<br \/>\npetitioners and that they do not have legal right to continue on the<br \/>\nland in question. Not only that but both the Courts have concurrently<br \/>\nfound that the petitioners are not in possession of the suit land in<br \/>\nquestion and they were removed much earlier. Considering above when<br \/>\nboth the Courts have refused to grant any injunction in favour of the<br \/>\npetitioners, same are not required to be interfered with in exercise<br \/>\nof powers under Article 227 of the Constitution of India. There is no<br \/>\njurisdictional error committed by the both the Courts below refusing<br \/>\nto grant injunction in favour of the petitioners.
