DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsel for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 30.04.2011<br \/>\n\tpassed by the respondent No.2<br \/>\n\tin exercise of powers conferred under Section 3(1) \/ 3(2) of the<br \/>\n\tGujarat Prevention of Anti Social Activities Act, 1985 (for short<br \/>\n\t&#8220;the Act&#8221;) by detaining the detenue as defined under<br \/>\n\tSection 2(g) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue submits that order of detention impugned in<br \/>\n\tthis petition deserves to be quashed and set aside and the ground<br \/>\n\tthat registration of solitary complaint for the offences under<br \/>\n\tSections 3, 4, 5, 7 &amp; 9 etc. of the Immoral<br \/>\n\tTraffic (Prevention) Act, 1956 by itself cannot bring the case of<br \/>\n\tthe detenue within the purview of definition under Section 2(g) of<br \/>\n\tthe Act. Further, learned counsel for the detenue submits that<br \/>\n\tillegal activity carried out as alleged cannot have any nexus or<br \/>\n\tbearing with maintenance of public order and at the most it can be<br \/>\n\tsaid to be breach of law and order.  Further, except statements of<br \/>\n\twitnesses,  registration of FIRs and panchnama no other relevant or<br \/>\n\tcogent material is available on record connecting the alleged<br \/>\n\tanti-social activities of the detenue with breach of public order.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue further submits that it is not possible to<br \/>\n\thold in the facts of the present case that the activities of the<br \/>\n\tdetenue with reference to the criminal case\/s had affected even<br \/>\n\ttempo of the society, posing a threat to the very existence of the<br \/>\n\tnormal and routine life of the people at large or that on the basis<br \/>\n\tof the  criminal case\/s, the detenue had put the entire social<br \/>\n\tapparatus in disorder, making it difficult for whole system to exist<br \/>\n\tas a system governed by rule of law by disturbing public order.\n<\/p>\n<p>Learned<br \/>\n\tAGP for the respondent-State supported the detention order passed by<br \/>\n\tthe authority and submitted that sufficient material and evidence<br \/>\n\twas found during the course of investigation, which was also<br \/>\n\tsupplied to the detenue itself indicate that the detenue is in habit<br \/>\n\tof indulging into activities as defined under Section 2(g) of the<br \/>\n\tAct and considering the facts of the case, the detaining authority<br \/>\n\thas rightly passed the order of detention and the detention order<br \/>\n\tdeserves to be upheld by this Court.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and considering the facts and<br \/>\n\tcircumstances of the case, it appears that the subjective<br \/>\n\tsatisfaction arrived at by the detaining authority cannot be said to<br \/>\n\tbe legal, valid and in accordance with law inasmuch as the offences<br \/>\n\talleged in the FIR\/s cannot have any bearing on the public order<br \/>\n\tsince the law of the land i.e. the Act, 1956 and other relevant<br \/>\n\tpenal laws are sufficient enough to take care of the situation and<br \/>\n\tthat the allegations as have been levelled against the detenue<br \/>\n\tcannot be said to be germane for the purpose of bringing the detenue<br \/>\n\twithin the meaning of Section 2(g) of the Act and unless and until<br \/>\n\tthe material is there to make out a case that the person concerned<br \/>\n\thas become a threat and a menace to the society so as to disturb the<br \/>\n\twhole tempo of the society and that the whole social apparatus is in<br \/>\n\tperil disturbing public order at the instance of such person, it<br \/>\n\tcannot be said that the detenue is a person within the meaning of<br \/>\n\tSection 2(g) of the Act.  Except general statement, there is no<br \/>\n\tmaterial on record which shows that the detenue is acting in such a<br \/>\n\tmanner which is dangerous to the public order.\n<\/p>\n<p>In<br \/>\n\tview of the above, I am inclined to allow this petition because<br \/>\n\tsimplicitor registration of FIR\/s by itself cannot have any nexus<br \/>\n\twith the breach of maintenance of public order and the authority can<br \/>\n\thave recourse under the Act, 1956 and no other relevant or cogent<br \/>\n\tmaterial exists for invoking powers under Section 3(1) \/ 3(2) of the<br \/>\n\tAct.  That the State Government<br \/>\n\thas not filed affidavit in reply to this petition.\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The impugned<br \/>\n\torder of detention dated 30.04.2011 passed by respondent No.2 is<br \/>\n\thereby quashed and set aside.  The detenue is ordered to be set at<br \/>\n\tliberty forthwith if not required in any other case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute accordingly.
