JUSTICE BIRENDRA PRASAD VERMA\n\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>2   06-07-2011                   This appeal under Clause 10 of the Letters Patent is<br \/>\n                 filed 521 days beyond the period of limitation.\n<\/p>\n<p>                                 The appellant, a retired employee of the Kshetriya<br \/>\n<span class=\"hidden_text\"> 2   Patna High Court LPA No.966 of 2011 (2) dt.06-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          2\/5<\/span><\/p>\n<p>             Gramin Bank &#8211; the respondent no. 1, (hereinafter referred to as<br \/>\n             `the Bank&#8217;), has preferred this appeal under Clause 10 of the<br \/>\n             Letters Patent against the judgment and order dated 6th August<br \/>\n             2009 passed by the learned single Judge in above CWJC No.<br \/>\n             12785 of 2004. Pending the petition, the appellant, on reaching<br \/>\n             the age of superannuation, retired from service.\n<\/p>\n<p>                              It appears that the appellant joined the Bank as<br \/>\n             officer. He was posted as Branch Manager on 3rd October 1980.<br \/>\n             In course of time he came to be transferred from one branch to<br \/>\n             another. In or around the year 2001 the appellant appears to<br \/>\n             have some dispute with the then Chairman of the Bank. On 4 th<br \/>\n             July 2002, a disciplinary proceeding was initiated against the<br \/>\n             appellant. One more disciplinary proceeding was initiated<br \/>\n             against him on 20th July 2002. After holding due enquiry, the<br \/>\n             appellant was found guilty of several charges leveled against<br \/>\n             him. In view of the said finding of guilt, by order dated 17th<br \/>\n             December 2003 made by the disciplinary authority &#8211; cum &#8211;<br \/>\n             Chairman of the Bank, the appellant was dismissed from<br \/>\n             service.\n<\/p>\n<p>                              The said order was carried in appeal before the<br \/>\n             Board of Directors by the appellant. The Board of Directors,<br \/>\n             under order dated 25th September 2004, allowed the appeal<br \/>\n             partially; set aside the order of dismissal from service, instead<br \/>\n             imposed punishment of reduction in pay upon the appellant; the<br \/>\n             period of suspension was ordered to be treated as such and the<br \/>\n             salary till the date of reinstatement in service was not allowed.\n<\/p>\n<p>                              The said order, in so far as it imposed punishment<br \/>\n             of reduction in pay and did not allow the past wages, was<br \/>\n             challenged by the appellant in above CWJC No. 12785 of 2004.\n<\/p>\n<p><span class=\"hidden_text\"> 3   Patna High Court LPA No.966 of 2011 (2) dt.06-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          3\/5<\/span><\/p>\n<p>             The appellant also made grievance that the order of the Board of<br \/>\n             Directors was not implemented. The appellant was not allowed<br \/>\n             to resume duty in spite of the order of the Board of Directors.<br \/>\n             The learned single Judge, by the impugned judgment and order<br \/>\n             dated 6th August 2009, allowed the writ petition to the extent<br \/>\n             that the Bank was directed to allow the appellant to join the<br \/>\n             service and to pay the salaries from the date of joining report till<br \/>\n             he reached the age of superannuation. Challenge to the said<br \/>\n             judgment by the Bank in LPA No. 1604 of 2009 failed.\n<\/p>\n<p>                              We are informed at the Bar that the aforesaid<br \/>\n             directions have been complied with.\n<\/p>\n<p>                              Feeling aggrieved by the said order the appellant<br \/>\n             filed MJC No. 3997 of 2010 for modification of the order. Same<br \/>\n             came to be dismissed on 6th April 2011. The learned single<br \/>\n             Judge held that in the guise of seeking modification of the order,<br \/>\n             the appellant demanded re-hearing of the writ petition. In view<br \/>\n             of the said observation, the appellant &#8211; petitioner has filed the<br \/>\n             present appeal against the above referred order dated 6 th April<br \/>\n             2011 after a considerable delay.\n<\/p>\n<p>                              Learned Advocate Mr. Shashi Bhushan Singh has<br \/>\n             appeared for the appellant. He has submitted that CWJC No.<br \/>\n             12785 of 2004 was not heard by the learned single Judge on<br \/>\n             merits. The appellant challenged the order of the Board of<br \/>\n             Directors imposing punishment of reduction in pay and not<br \/>\n             allowing the wages for the interregnum period. The said<br \/>\n             challenge was not considered by the learned single Judge; nor<br \/>\n             the learned single Judge rendered his decision on the said issue.<br \/>\n             He has submitted that the delay in question occurred on account<br \/>\n             of the appellant&#8217;s pursuing the remedy before the learned single<br \/>\n<span class=\"hidden_text\"> 4   Patna High Court LPA No.966 of 2011 (2) dt.06-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          4\/5<\/span><\/p>\n<p>             Judge in above referred MJC No. 3977 of 2010. The appeal<br \/>\n             could be preferred only after the said application was rejected.\n<\/p>\n<p>                              Learned Advocate Mr. Prabhakar Jha has appeared<br \/>\n             for the Bank. He has submitted that since the impugned<br \/>\n             judgment and order dated 6th August 2009 the appellant<br \/>\n             preferred CWJC No. 13478 of 2010 in the same subject matter.<br \/>\n             It came to be dismissed on 25th August 2010. The factum of the<br \/>\n             said writ petition and the decision on it has not been disclosed in<br \/>\n             the present appeal. He has produced the memo of the said<br \/>\n             CWJC No. 13478 of 2010.\n<\/p>\n<p>                              In CWJC No. 13478 of 2010 the appellant sought<br \/>\n             directions to allow the revised time scale from 29th October<br \/>\n             2002 and claimed recovery of the amount of difference in salary.<br \/>\n             According to the appellant, the learned single Judge, while<br \/>\n             deciding CWJC No. 12785 of 2004, had not confirmed the guilt<br \/>\n             of the appellant and the punishment imposed upon the appellant.<br \/>\n             The appellant was, therefore, entitled to the benefit of revised<br \/>\n             time scale.\n<\/p>\n<p>                              It is apparent that the above referred CWJC No.<br \/>\n             13478 of 2010 also arose from the same cause of action, i.e. the<br \/>\n             disciplinary proceeding held against the appellant and the order<br \/>\n             of punishment.\n<\/p>\n<p>                              To us, it appears that the challenge to the impugned<br \/>\n             judgment dated 6th August 2009 in the present appeal is an<br \/>\n             afterthought. The appellant first tried to avail the benefit of want<br \/>\n             of specific finding in respect of the guilt proved against him in<br \/>\n             the impugned judgment dated 6th August 2009, in CWJC No.<br \/>\n             13478 of 2010. Long thereafter, he filed application for<br \/>\n             modification. It may be noted that the application for<br \/>\n<span class=\"hidden_text\"> 5        Patna High Court LPA No.966 of 2011 (2) dt.06-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                               5\/5<\/span><\/p>\n<p>                  modification was also not filed within the period of limitation<br \/>\n                  for filing appeal. It, therefore, cannot be said that the appellant<br \/>\n                  could not file the present appeal within the period of limitation<br \/>\n                  because of pendency of MJC No. 3977 of 2010 or because he<br \/>\n                  was pursing an alternative remedy.\n<\/p>\n<p>                                   We are not satisfied about the cause of inordinate<br \/>\n                  delay of 521 days occurred in filing the present appeal.<br \/>\n                  Moreover, the suppression of fact regarding filing of CWJC No.<br \/>\n                  13478 of 2010 (rejected on 25th August 2010) by the appellant<br \/>\n                  amounts to abuse of process of law. The appeal deserves to be<br \/>\n                  dismissed on the ground of suppression of material facts also.\n<\/p>\n<p>                                   For the aforesaid reasons, the appeal and the<br \/>\n                  interlocutory application are dismissed.\n<\/p>\n<p>                                                 (R.M.
