Learned  counsel Shri Joshi with Shri Naik for<br \/>\n\tthe company states that, apropos the statement made on 20\/9\/2011,<br \/>\n\tbased upon the affidavit of the company, an amount of<br \/>\n\tRs.8,78,00,000\/- was to be deposited towards payment of dues of<br \/>\n\tthose employees and towards those employees who have died or who<br \/>\n\thave reached the age of superannuation. The company is, therefore,<br \/>\n\tdepositing Rs.8,78,00,000\/- by 18\/10\/2011 before the concerned<br \/>\n\tIndustrial Tribunal, Surat.  The advocates for the workmen have<br \/>\n\tsubmitted that this depositing of money may be without prejudice to<br \/>\n\tthe rights &amp; contentions of the workmen being agitated in the<br \/>\n\tpetitions, and in addition the amount to  be paid to the heirs of<br \/>\n\tthe employees who have died or retired, it may be ordered to be<br \/>\n\tdistributed amongst all the workmen who are waiting since long as<br \/>\n\tpart payment towards their claims which may be adjusted against<br \/>\n\ttheir final claim.\n<\/p>\n<p>In<br \/>\n\tview of this, let the company deposit an amount of Rs.8,78,00,000\/-<br \/>\n\t(Rs. Eight crores and seventy eight lakhs only) on or before<br \/>\n\t18\/10\/2011 before the Industrial Court, Surat. The said amount be<br \/>\n\tdistributed in equal proportion to all the concerned workmen, list<br \/>\n\twhereof be prepared by the workmen in consultation with their<br \/>\n\tadvocates and advocates of the company. On presentation of this list<br \/>\n\tby 19\/10\/2011 or by 20\/10\/2011 whichever is early, the Tribunal<br \/>\n\tshall disburse the amount in equal proportion to the persons<br \/>\n\tfiguring in the list by proper identification of person and by way<br \/>\n\tof account payee cheque or by bank draft.\n<\/p>\n<p>The<br \/>\n\tsaid disbursement would naturally be without prejudice to the rights<br \/>\n\t&amp; contentions of both the sides in any manner. The Industrial<br \/>\n\tTribunal, Surat, shall monitor disbursement of the amount as stated<br \/>\n\therein above.\n<\/p>\n<p>Matters<br \/>\n\tto come up on 21\/10\/2011.\n<\/p>\n<p>                                                           [<br \/>\nS.R.
