  award of the Tribunal, I am of the View that the<\/p>\n
compensation awarded by the Tribunal is not just and<\/p>\n

\nThe?   the claimant’ are<\/p>\n
evident from certificate EX.P–3, scanning<\/p>\n
 report ‘EX.P–u4’1.gdisability certificate EXP-42, X–rays<\/p>\n
‘   and supported by oral evidence of the<\/p>\n
clainiantufand doctor, who were examined as PWs\u00ab~1<\/p>\n
 and Ez\ufb01reslpectively. PW-2, the doctor who treated the<\/p>\n
 claimant has opined that injury No.1, 2 and 3 are<\/p>\n
  grievous and injury No.4 is simple in nature. He has<\/p>\n
stated in his evidence that he examined the claimant<\/p>\n
on 29.11.2006 and found that there was a pain in the
\ngf,<\/p>\n

back and chest and swelling in chest  also<\/p>\n
considering other problems facing by the <\/p>\n
has assessed partial permanent  <\/p>\n
extent of 7%.\n<\/p>\n
8. Considering the “”nat_u”re t”–o’f–._ inj1_j’rie’s,<\/p>\n
Rs.48.000\/– awarded by\u00bb :ijie.rrrb”unai s:’pain”<\/p>\n
and suffering’ is on the Iower   i’s*d’eserVed to
\nbe enhanced by  and 1 award<\/p>\n
Rs.50,000\/5  this .?{ead’;tti s it  i<\/p>\n
9:  As  — awarded by the<\/p>\n
Tribunal towards ‘rnedicai expenses’ is based on the<\/p>\n
‘  produced by the claimant. The same is<\/p>\n
 Rs.16.000\/- and awarded towards<\/p>\n
 ‘rnedica,1_ expenses’ and there is no scope for<\/p>\n
“IT enhancement under this head.<\/p>\n
10. The claimant was treated as inpatient for a<\/p>\n
 period of 16 days in Chinrnayi Hospital, Kundapura.<\/p>\n
Considering the duration of treatment, Rs.5,750\/–<\/p>\n

12. Considering the disability stated  the<\/p>\n
doctor and an amount of discomfort and unhappiness<\/p>\n
the claimant has to undergo in her future ‘it. <\/p>\n
