M. SAHAI)<\/a><\/p>\n<p>1.\tWe<br \/>\nhave heard Mr.Mihir Joshi, learned Senior Counsel assisted by<br \/>\nMs.Amrita Thakor for Singhi &amp; Company for the petitioners and<br \/>\nMs.Davavala learned counsel for the respondents.\tLearned counsel for<br \/>\nthe respondents has also produced the records.\n<\/p>\n<p>2.\tThe<br \/>\ntenders were invited by the respondents for supply of MP\/HDPE (DWC)<br \/>\nPIPE\/10-11\/07 along with DWC HDPE Ducts.  The bids was by two bid<br \/>\nsystem. Technical bid and Price bid were required to be submitted by<br \/>\nthe tenderer. If the a tenderer qualified in the technical bid then<br \/>\nonly the price bid was to be required to be considered. The<br \/>\npetitioner submitted his tender along with relevant documents. By<br \/>\nletter dated 16.05.2011 and the same papers were demanded again from<br \/>\nthe petitioner in view of Clause-20 of the tender documents which was<br \/>\nsupplied by the petitioners. This petition has been filed by the<br \/>\npetitioners on the ground that there were three bidders and bid was<br \/>\nto be distributed amongst three bidders for package one.\n<\/p>\n<p>3.\tOnly<br \/>\nthree tenderer have participated and submitted the technical bid and<br \/>\nthe petitioner and one another tenderer, bid was not accepted in the<br \/>\ntechnical bid. The technical bid of respondent no.4 was accepted.<br \/>\nOnly respondent no.4 was considered in the price bid.\n<\/p>\n<p>4.\tMs.Davavala,<br \/>\nlearned counsel has urged that the petitioner&#8217;s technical bid had not<br \/>\nbeen accepted on the ground that the petitioners  did not submit the<br \/>\ncertificate from all the Directors of the company with proper<br \/>\nsignature as provided in the certificate performa.\n<\/p>\n<p>5.\tFrom<br \/>\nthe original record, it is found that all the Directors of the<br \/>\npetitioner company have given the certificate that none of their<br \/>\nrelatives were working in BSNL. The objection of the learned counsel<br \/>\nfor the respondents that the performa could not be changed and once<br \/>\n&#8220;I&#8221; was written every Director was required to be submit a<br \/>\nseparate certificate cannot be accepted as &#8220;We&#8221; was written<br \/>\nand all the Directors have signed on the next page of the<br \/>\ncertificate. The certificate was a valid certificate.\n<\/p>\n<p>6.\tThe<br \/>\nother objection of the learned counsel for the respondents was that<br \/>\nthe registration certificate from the State Director of Industries<br \/>\nwas not certified. \tFrom the original tender documents, we find that<br \/>\nthe petitioners have submitted the certificate from the District<br \/>\nIndustries Center, Sangli, Director of Industries, Government of<br \/>\nMaharashtra and which was also certified by the Special Executive<br \/>\nMagistrate therefore, this document was liable to be accepted by the<br \/>\nrespondents. Under mistake the respondents have not accepted though<br \/>\nthey have accepted the certificate of the respondent no.4 which was<br \/>\nonly self-attested and notarized but it was not certified. From the<br \/>\ntender condition of the tender document, we do not find that<br \/>\nself-attested or notarized certificate was acceptable. However, since<br \/>\nthe respondents are ready to accept the petitioners&#8217; tender and his<br \/>\ntechnical bid and  ready to open the petitioners&#8217; price bid,<br \/>\ntherefore, we do not declare invalid the tender of respondent no.4 on<br \/>\ntechnical ground.\n<\/p>\n<p>7.\tFor<br \/>\nthe aforesaid reasons, this writ petition is disposed of with a<br \/>\ndirection to the respondents not to reject the technical bid of the<br \/>\npetitioner and after accepting his technical bid consider his price<br \/>\nbid along with price bid of respondent no.4.\tThe respondents shall<br \/>\nalso inform the date to the petitioners on which the price bid of the<br \/>\npetitioner would be opened.
