Justice V.RAMKUMAR\n\n Dated :16\/03\/2009\n\n O R D E R\n                    * * *B.A.* *NO.*1192*of* * * * * *\n                     * * * *V.*RAMKUMAR,2009* *\n                            * * * * * * * * *J.* *\n\n                   Dated:* 16th day of March, 2009\n                                 * * * *\n\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner who is the 2nd accused in Crime No. 236 of 2009 of<br \/>\nIrinjalakuda     Police Station for offences punishable under<br \/>\nSections 448 and 307 read with Sec. 34 I.P.C. seeks anticipatory<br \/>\nbail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.\n<\/p>\n<p>      3.     Anticipatory bail cannot be granted in a case of this<br \/>\nnature. But at the same time, I am inclined to permit the petitioner<br \/>\nto surrender before the Investigating Officer for the purpose of<br \/>\ninterrogation and then to have his application for bail considered by<br \/>\nthe Magistrate having jurisdiction. Accordingly, the petitioner shall<br \/>\nsurrender    before    the     investigating    officer on  any  day<br \/>\nbetween     20-3-2009      and    24-3-2009       for the purpose  of<br \/>\ninterrogation and recovery of incriminating material, if any.
