PUBLIC PROSECUTOR for Respondent(s) : 1, \nNone\nfor Respondent(s) : 2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 25\/02\/2011\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>Present<br \/>\n\tapplications are filed by the applicant under Section 439 of the<br \/>\n\tCriminal Procedure Code, 1973 for releasing him on regular bail in<br \/>\n\tconnection with CR No.I-96 of 2010, CR No.I-97 of 2010 and CR<br \/>\n\tNo.I-99 of 2010 registered with Salabatpura Police Station, Surat in<br \/>\n\tthe respective application for the offences punishable under<br \/>\n\tSections 406, 420, 409, 411, 120(B) and 114 of the Indian Penal<br \/>\n\tCode.\n<\/p>\n<p>Heard<br \/>\n\tMr.R.R. Marshall, learned senior counsel with Mr.Adil Mirza, learned<br \/>\n\tcounsel for the applicant and  Mr.H.L. Jani, learned Additional<br \/>\n\tPublic Prosecutor for the respondent No.1-State.\n<\/p>\n<p>Mr.Marshall<br \/>\n\thas submitted that the applicant is innocent and has not committed<br \/>\n\tany offence as alleged against him. He has also contended that<br \/>\n\tnothing is recovered from the present applicant. Mr.Marshall has<br \/>\n\tread the First Information Report and contended this is a case of<br \/>\n\tcivil in nature, for which the complainant could have filed Civil<br \/>\n\tSuit for recovery of the amount. He has also read the provision of<br \/>\n\tSections 405 and 415 of the Indian Penal Code and argued that<br \/>\n\tprosecution has failed to establish case beyond reasonable doubt<br \/>\n\tagainst the present applicant. He has also contended that applicant<br \/>\n\thas not played any active role in the offence in question.<br \/>\n\tMr.Marshall has also contended that other co-accused have already<br \/>\n\tbeen released on bail and therefore, on the ground of parity also,<br \/>\n\tpresent application is required to be allowed.\n<\/p>\n<p>As<br \/>\n\tagainst this, Mr.Jani, learned Additional Public Prosecutor, has<br \/>\n\tstrongly opposed the present application. He has contended that the<br \/>\n\tapplicant is a habitual offender and looking to the huge amount<br \/>\n\tinvolved in the present case, application deserves to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave gone through the order passed by the trial Court as well as<br \/>\n\tpapers produced on record of the case. I have also considered the<br \/>\n\tsubmissions advanced by the learned counsel for the parties. Looking<br \/>\n\tto the papers, it appears that main ingredients of Sections 405 and<br \/>\n\t415 are not established beyond reasonable doubt against the present<br \/>\n\tapplicant. Looking to the allegations levelled against the<br \/>\n\tapplicant, without entering into the merits of the case, I am of the<br \/>\n\topinion that this is a fit case to grant the bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for a reasoned order.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions made on behalf of the parties and having regard to<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand applicant is ordered to be released on bail in connection with<br \/>\n\tCR No.I-96 of 2010, CR No.I-97 of 2010 and CR No.I-99 of 2010<br \/>\n\tregistered with Salabatpura Police Station, Surat in the respective<br \/>\n\tapplication for the offences alleged against him in the respective<br \/>\n\tapplication on his executing a bond of Rs.1,00,000\/- (Rupees One<br \/>\n\tLakh Only) in each application, (i.e. Rs.3,00,000\/-), with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall,<\/p>\n<p>(I)\tnot<br \/>\ntake undue advantage of his liberty or\tabuse his liberty;\n<\/p>\n<p>(ii)\tnot<br \/>\nact in a manner injurious to the\tprosecution;\n<\/p>\n<p>(iii)\tnot<br \/>\nleave the local limits of State of Gujarat\twithout the prior<br \/>\npermission of the concerned\tSessions Judge;\n<\/p>\n<p>(iv)\tmark<br \/>\nhis presence before the Investigating\tOfficer on every 15th<br \/>\nday of the calender\tmonth \tbetween 09:00 a.m. to 02:00 p.m.;\n<\/p>\n<p>(v)\tSurrender<br \/>\nhis passport, if any, to the lower\tCourt within a week;\n<\/p>\n<p>(vi)\tfurnish<br \/>\nthe present address of residence to the \tInvestigating Officer as<br \/>\nwell as to the Court at\tthe time of furnishing bond and shall<br \/>\nnot\tchange his residence till further orders;\n<\/p>\n<p>(vii)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>The<br \/>\n\tAuthority will release the applicant only if he is not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.
