DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP waives service of Rule.\n<\/p>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-73 of 2011 with Limkheda police station for the offences<br \/>\npunishable under Sections 379, 411 of the Indian Penal Code, Section<br \/>\n3 and 7 of the Essential Commodities Act, 3, 15(2) of the Petroleum<br \/>\nand Minerals Pipelines Act, 3 and 7 of the Pubic Property Damages Act<br \/>\nand under Section 23 of the Petroleum Act 1934.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\naccusations, role attributed to the applicants and punishment<br \/>\nprescribed,  without discussing the evidence in detail, prima facie,<br \/>\nthis Court is of the opinion that this is a fit case to exercise the<br \/>\ndiscretion to enlarge the applicants on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicants are ordered to be<br \/>\nreleased on bail in connection with  first information report<br \/>\nregistered at C.R.No.I-73 of 2011 with Limkheda police station on<br \/>\ntheir executing a bond of Rs.5,000\/- (Rupees five thousand only) each<br \/>\nwith one surety of the like amount to the satisfaction of the trial<br \/>\ncourt and subject to the conditions that they shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>the<br \/>\n\tapplicants shall not enter into Dahod and Panchmahal District for a<br \/>\n\tperiod of three months except for marking presence and attending<br \/>\n\ttrial;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10 a.m. and 3 p.m till commencement of the<br \/>\n\ttrial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of their residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicants on bail.
