          This appeal is filed at the instance of the<\/p>\n
complainant in C.C.No.338 of 1995, on the file of the court<\/p>\n
of the Munsiff Magistrate, Paravur, a case which was<\/p>\n
instituted upon a private complaint for the offence<\/p>\n
punishable   under      Section     138    of    the    Negotiable<\/p>\n
Instruments Act. The court below acquitted the accused<\/p>\n
by its order dated 25.9.1997 for the sole reason that the<\/p>\n
complainant was not present either personally or through<\/p>\n
his counsel.   It is the above order, challenged in this<\/p>\n
appeal.\n<\/p>\n
      2.  In the complaint, the case of the appellant\/<\/p>\n
complainant is that towards the discharge of the liability of<\/p>\n
Rs.60,000\/- which was due to the complainant, the accused<\/p>\n
had issued a cheque dated 9.1.1995.            When the cheque<\/p>\n
was presented for encashment, it was dishonoured for<\/p>\n
want of sufficient fund. After the statutory formalities, the<\/p>\n
complainant preferred the complaint, in spite of the<\/p>\n
intimation regarding the dishonour of cheque and request<\/p>\n

for the payment of the amount. The sworn statement of<\/p>\n
the complainant was recorded on 8.5.1995 and<\/p>\n
cognizance was taken on 3.6.1995 and process was<\/p>\n
issued to the accused.      Subsequently, the case was<\/p>\n
adjourned to various dates. On almost all the dates, the<\/p>\n
complainant was present either in person or through his<\/p>\n
pleader.    It is also discernible from the averments<\/p>\n
contained in paragraph 2 of the appeal memorandum<\/p>\n
that since the accused did not appear in the court, non-<\/p>\n
bailable warrant was issued and consequently, the<\/p>\n
accused was arrested and produced and subsequently,<\/p>\n
bail was granted to him. It is also discernible from the<\/p>\n
factual averments that the case has been adjourned<\/p>\n
because of non-sitting of the court and also it appears<\/p>\n
that non-bailable warrant was issued against the<\/p>\n
accused. It can also be seen that on the basis of the<\/p>\n
judgment of the Supreme Court in common cause case,<\/p>\n
the accused was acquitted, but subsequently, the case<\/p>\n
was restored on the file on 31.3.1997. Because of the<\/p>\n
absence of the accused, the court was constrained to<\/p>\n

issue coercive steps against the accused.      It is also<\/p>\n
stated that as the accused was absent on 21.8.1997, the<\/p>\n
court below has directed to repeat the non-bailable<\/p>\n
warrant to the accused on which date also the<\/p>\n
complainant was present.          But, according to the<\/p>\n
appellant, on 25.9.1997, the complainant could not<\/p>\n
appear in person and therefore, he had informed his<\/p>\n
counsel about his inconvenience and requested the<\/p>\n
counsel to make arrangements for filing an application<\/p>\n
for exemption.      It is also stated that because of the<\/p>\n
traffic problem, counsel for the complainant could not<\/p>\n
appear in court when the case was called on 25.9.1997<\/p>\n
and hence, the court below passed the impugned order.<\/p>\n
      3.    I have heard counsel for the appellant.<\/p>\n
Though service of notice was effected on the first<\/p>\n
respondent\/accused, he had not chosen to appear in this<\/p>\n
court to defend the appeal.\n<\/p>\n
      4.    From the facts stated above, it appears to me<\/p>\n
that the appellant\/complainant is not a persistent<\/p>\n
defaulter in appearing before the court and negligent in<\/p>\n

prosecuting the complaint. It is also clear from the facts<\/p>\n
given in the appeal memorandum, which is not<\/p>\n
controverted, that the complainant was present in the<\/p>\n
court below on all occasions either by appearing himself<\/p>\n
or through his pleader and even on the date of the<\/p>\n
impugned order itself, the complainant had made<\/p>\n
arrangements to make application for exemption from<\/p>\n
his personal appearance, but his counsel could not reach<\/p>\n
in the court in time and therefore, when the case was<\/p>\n
called, there was no proper representation. It is also<\/p>\n
discernible from the proceedings stated in the appeal<\/p>\n
memorandum that when the case was adjourned to<\/p>\n
21.8.1997, the presence of the accused was not<\/p>\n
procured and hence, the court took coercive steps for<\/p>\n
securing his presence and accordingly, the case was<\/p>\n
adjourned to 25.9.1997 and therefore, the absence of<\/p>\n
the complainant on 25.9.1997 has affected no way the<\/p>\n
proceedings. It is not discernible from the impugned<\/p>\n
order as to whether the accused was present on that<\/p>\n
day. However, from the proceedings indicated above,<\/p>\n

the absence of the complainant is in no way affected the<\/p>\n
proceedings of the court below and the court could have<\/p>\n
granted opportunity to the complainant to prosecute the<\/p>\n
complaint as he is a person who is diligently prosecuting<\/p>\n
the complaint without any fault from his side.<\/p>\n
Therefore, according to me, the impugned order of the<\/p>\n
court below is not sustainable, especially in the light of<\/p>\n
the decision of the Supreme Court reported in<\/p>\n
Associated Cement Co.Ltd. v. Keshavanand [1998(1)<\/p>\n
KLT 179 (SC)].\n<\/p>\n
     5. In the result, the appeal is allowed. The order<\/p>\n
of the court below dated 25.9.1997 in C.C.No.338 of<\/p>\n
1995 is set aside. The complainant is directed to appear<\/p>\n
before the court below on 7th November, 2008 on<\/p>\n
which date the court is directed to take the complaint on<\/p>\n
file and to proceed in accordance with law and to<\/p>\n
dispose of the same on merit.<\/p>\n
