file of the Civil Judge (Sr.Dn) & Additional CEM, Arasikere,
\npartly allowing the appeal and setting aside the judgment and<\/p>\n
decree dated 07.11.2005 passed in O.S.No.22-4\/2003 <\/p>\n
file of the Principal Civil Judge (Jr.Dn), Arsikere.<\/p>\n
This Regular Second Appeal coming  if<\/p>\n
this day, the court delivered the following:’*–. A <\/p>\n
UDGMENT <\/p>\n
Heard the learned counsel afoaf the._a”ppellant’  the V<\/p>\n
respondent.\n<\/p>\n
2. The appellant;-was plai.\u00a7iti:ff\u00ab.y_in a” suit for<\/p>\n
declaratioinwiand:poss:esision~..;:”The iaippiellant had claimed that
\nthe suit property’  property and that the<\/p>\n
defendaritpp ought. tobe hestirained from interfering with his<\/p>\n
‘possession, The suit was decreed in favour of the appellant<\/p>\n
i’nspii–t_e of eo_nteat”hy the respondent herein. The same having<\/p>\n
‘V beeniii’cai”ried’  appeal, the lower appellate court has found<\/p>\n
 iC_’thiati”t-he gxhibit P.l would disclose that the property was<\/p>\n
0′  granted in favour of the plaintiff. The plaintiff and the<\/p>\n
 defendant are brothers and had \ufb01red jointly up to the year<\/p>\n
1974 and that the Grant Certi\ufb01cate was issued in favour of<\/p>\n
the appellant in the year 1983. However, the partition deed<\/p>\n
that was set up as per Exhibit 13.2 being an unregi_Sterc.di~.._<\/p>\n
document, the lower appellate court held that it  ~<\/p>\n
admissible in law and there was nca””m-entioitr of  <\/p>\n
property in the schedule to the partitionzdeed. Si1_hi_1arly, <\/p>\n
no.4 also was not mentioned in the\u00abl3″iSchedalei_ and’.=therel’ore,
\nit could not be acceptedi:_as._ a clieedi,iof.,_p.airtition  took
\ninto account all the itenisef. pr,0pert;yv,of’:ithe*i”family. The<\/p>\n
lower appell.a.te.coiitrtyhasi’ifo_andtl;at”‘t’he mother of the
\nplaintiff andiihlsi.i’,_.,si_steiri wpeiretnot parties to the partition deed
\nand since’ they were  to a share, their exclusion<\/p>\n
was therefore aglaring circumstance, which did not enable<\/p>\n
 the ..part,iiesptoi.’1iel_y upon the said partition deed. The lower<\/p>\n
i’appe–1tat\u00e9  also held that insofar as Exhibit 13.1<\/p>\n
 sought. tape produced by the respondent was concerned, it<\/p>\n
‘ilwasii”apparently a tampered document and therefore no<\/p>\n
 _Mr_\u00e9liance could he placed on it. In that View of the matter,<\/p>\n
the lower appellate court founjghat insofar as possession pf<\/p>\n
the suit property is concerned, the plaintiff had clearly<\/p>\n
established that he was in continuous possession of the same<\/p>\n
and therefore, at best could be entitled to the re1j.efi_i”o_}fi’~..V<\/p>\n
perinaneiit injunction, but it could not be said that_.p’iiiere:ipi2vas–i  A i-<\/p>\n
absolute right and title over the proprxerty’-by the   <\/p>\n
the right of the fact that the partition aeee coi;id”not <\/p>\n
accepted in establishing that therewqas a partitions  Between
\nthe plaintiff and the respondent.  .iACpo_i’di.ngiy,  lower<\/p>\n
appellate court has modified }the_ 3’iidg.ir:enti5i,pVarid decree to
\nrestrict the reiief44toion_e oi’\u00abpe=;:nianent ,injiiii’ction till such time
\nthat tliti plaiiitiwff he\ufb02dispossesised or the defendant -\u00ab~
\nrespondentpcould  right insofar as the property<\/p>\n
was ‘concerned  apipropriate proceedings, if he was entitled.<\/p>\n
 this iudgirtent which is sought to be questioned in the<\/p>\n
present  V V S<\/p>\n
 A.  .3’: ii The appeal has been admitted on the following<\/p>\n
iisuhstantial question of law namely, whether the lower<\/p>\n
“appellate coiirt was in error in not granting the relief of<\/p>\n

declaration, having held that the land was granted to the<\/p>\n
plaintiff as per Exhibit P. 1.\n<\/p>\n
4. Since the lower appellate court has zregated <\/p>\n
partition deed, which was relied upon by the  if<\/p>\n
the trial court, the only conclusionlawasrzhatu’–the._lpartit,i’op <\/p>\n
between the parties was not
