Sasidharan, J. <\/p>\n<p>1. Petitioner is the accused in C.C. 540 of 2001 on<br \/>\nthe file of the Judicial Magistrate of the First Class,<br \/>\nThiruvalla. The allegation against the petitioner is<br \/>\nthat he committed the offence punishable under Section<br \/>\n138 of the Negotiable Instrument Act. The statement in<br \/>\nthe complaint is that the petitioner obtained a loan of<br \/>\n3.8 lakh dirhams for conducting the business of provision<br \/>\nstore and canteen. Petitioner issued a cheque for 16,000<br \/>\ndirhams on 1-1-2001 towards part payment of the amount<br \/>\nborrowed from the second respondent. The cheque was<br \/>\ndrawn on M\/s. Abudabi Commercial Bank, Industrial Area<br \/>\nBranch, Sharjah and the second respondent presented the<br \/>\ncheque in M\/s. Indian Overseas Bank, Thiruvalla Branch on<br \/>\n22-1-2001. The cheque was dishonoured for the reason<br \/>\nthat there was no sufficient amount in the account for<br \/>\nmaking payment of the amount covered by the cheque.<br \/>\nSecond respondent got intimation regarding the dishonour<br \/>\nof the cheque on 7-2-2001 and notice was sent to the<br \/>\npetitioner informing the dishonour of the cheque. The<br \/>\ncomplaint alleging commission of the offence punishable<br \/>\nunder Section 138 of the Negotiable Instrument Act was<br \/>\nfiled alleging that in spite of issuance of notice the<br \/>\npetitioner did not pay the amount covered by the cheque.\n<\/p>\n<p>2. According to the petitioner, in<br \/>\nconnection with a chitty transaction he had to give a<br \/>\nsigned blank cheque as security along with the other<br \/>\ndocuments. One of the contentions raised by the<br \/>\npetitioner is that the cheque was drawn on a bank in<br \/>\nSharjah and the transaction was also in Sharjah. It is<br \/>\nstated that no part of the transaction took place within<br \/>\nIndia and no complaint can be filed under Section 138 of<br \/>\nthe Negotiable Instruments Act. There is also contention<br \/>\nthat even if the allegations in the complaint are true,<br \/>\nthe alleged transaction is in clear violation of the<br \/>\nprovisions of the Foreign Exchange Management Act, 1999.\n<\/p>\n<p>3. The cheque in question was drawn on<br \/>\nM\/s. Abudabi Commercial Bank, Industrial Area Branch,<br \/>\nSharjah. The second respondent presented the cheque in<br \/>\nM\/s. Indian Overseas Bank, Thiruvalla Branch on 22-1-2001.<br \/>\nThen the second respondent got intimation that the cheque<br \/>\nwas dishonoured for the reason that there was no<br \/>\nsufficient amount in the account of the petitioner. The<br \/>\npetitioner would contend that the cheque was issued in<br \/>\nSharjah drawn on a bank in Sharjah and the entire<br \/>\ntransaction was in Sharjah and hence it cannot be said<br \/>\nthat the offence punishable under Section 138 of the<br \/>\nNegotiable Instruments Act was committed. There is no<br \/>\nmerit in the above contention raised by the petitioner in<br \/>\nthe light of the decision of the Supreme Court in<br \/>\nBhaskaran v. Balan (1999 [3] KLT 440 [SC] in which it<br \/>\nwas held that drawing of cheque, presentation of the<br \/>\ncheque to the bank, returning the cheque unpaid by the<br \/>\ndrawee bank, giving notice in writing to the drawer of<br \/>\nthe cheque demanding payment of the cheque amount and<br \/>\nfailure of the drawer to make payment within 15 days of<br \/>\nreceipt of notice are the components of the offence under<br \/>\nSection 138 of the Negotiable Instruments Act and that if<br \/>\nthe five different acts were done in fie different<br \/>\nlocalities any one of the courts exercising jurisdiction<br \/>\nin one of the five local areas can become the place of<br \/>\ntrial for the offence under Section 138 of the Act.<br \/>\nSince the presentation of the cheque for encashment was<br \/>\nat a place within the jurisdiction of a court in which<br \/>\ncomplaint is filed the complaint alleging commission of<br \/>\nthe offence under Section 138 of the Act can be<br \/>\nmaintained in that Court.\n<\/p>\n<p>4. A decision on the contention raised by<br \/>\nthe petitioner that he was forced to give signed blank<br \/>\ncheque to the second respondent in connection with a<br \/>\nchitty transaction along with other documents and that<br \/>\nwas given towards security, can be taken only after<br \/>\ntaking evidence. A final decision on that question<br \/>\ncannot be taken in a proceedings under Section 482 of the<br \/>\nCriminal Procedure Code. In respect of the contention<br \/>\nraised that the money transaction is in violation of the<br \/>\nprovisions of the Foreign Exchange Management Act, 1999<br \/>\nwhat has to be said is that even if there is violation of<br \/>\nthe provisions of that Act the parties to the money<br \/>\ntransactions have to face the consequences mentioned in<br \/>\nthat Act for the violation and that has nothing to do<br \/>\nwith the allegation that the petitioner committed the<br \/>\noffence under Section 138 of the Negotiable Instrument<br \/>\nAct. This is a case in which the cheque was presented in<br \/>\na bank in India for collection of the amount and when<br \/>\nthat cheque was sent for encashment that was returned<br \/>\nwith the endorsement that there was no sufficient amount<br \/>\nin the account to honour the cheque.\n<\/p>\n<p>There are no grounds for quashing the proceedings<br \/>\nin the case and this petition is hence dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mattathil Ouseph Ittira vs State Of Kerala, Rep.
