         This appeal is filed by the insurance company<\/p>\n
contending that   quantum of compensation awarded by the<\/p>\n
tribunal was very high and insurance company is not<\/p>\n
liable to compensate the claimants for the death of their<\/p>\n
dependent.   An elderly person died in an accident on<\/p>\n
21.7.1993.  While walking along the road, he was hit by<\/p>\n
the  autorickshaw  bearing  registration  No.  KL  5\/2735<\/p>\n
insured by the appellant insurance company.   Eight legal<\/p>\n
representatives (wife and children) filed an application<\/p>\n
for compensation.  Tribunal awarded only Rs.50,000\/- with<\/p>\n
interest.  With regard to the quantum of compensation,<\/p>\n
the deceased was a blacksmith.    Even though Rs.1,500\/-<\/p>\n
was  claimed  as  monthly  income,   in  the  absence  of<\/p>\n
evidence, only Rs.1,000\/- was taken as the monthly income<\/p>\n
which is below the notional income for a non-earning<\/p>\n

person fixed under the Second Schedule.     Considering the<\/p>\n
old age, only 5 was taken as the multiplier.     Therefore,<\/p>\n
at no stretch of imagination, it can be stated that<\/p>\n
multiplier adopted was excessive or more than just and<\/p>\n
reasonable compensation was awarded.<\/p>\n
              2. The tribunal found that the driver of the<\/p>\n
autorickshaw insured by the appellant was responsible for<\/p>\n
the accident because the driver had no valid driving<\/p>\n
licence and there is violation of policy conditions.   The<\/p>\n
tribunal accepted the above contention and allowed the<\/p>\n
insurance company to recover the amount from the insured.<\/p>\n
The Supreme Court in various cases including National<\/p>\n
Insurance Company Ltd. v. Baljit Kaur and others (AIR<\/a><\/p>\n
2004 SC 1340) and Oriental Insurance Company Ltd. v.<\/p>\n
Nanjappa and others (AIR 2004 SC 1630) held that when<\/p>\n
there is violation of insurance policy, statutory third<\/p>\n
party     liability   of  the  insurance company cannot  be<\/p>\n
evaded,      but,  due  to  violation  of policy condition,<\/p>\n
insurance company is entitled to recover the same from<\/p>\n
the insured.        Coverage of the vehicle by the policy<\/p>\n
issued      by   the appellant   insurance company is   not<\/p>\n
disputed. The tribunal has given the right to recover<\/p>\n

the amount from the insured.     In the above circumstances,<\/p>\n
we see no ground to interfere in the award.<\/p>\n
