Appellant not present. The Public Authority is<br \/>\nrepresented by Shri Deepankar Sasmal, DGM(Admn.) and Shri Raj Kumar Singh,<br \/>\nSDE(Arch). They are heard and the records perused.\n<\/p>\n<p>2.     This case has a long journey. It was decided by this Commission vide order dated<br \/>\n31.8.2009. The occasion for this hearing has arisen due to alleged non-compliance of this<br \/>\nCommission&#8217;s orders.\n<\/p>\n<p>3.      Shri Sasmal submits that appellant&#8217;s son Shri Amit Talwar is presently working as<br \/>\nJTO(Arch) in BSNL. He was earlier working in Department of Posts &amp; Telegraphs. The<br \/>\nmigration took place in 2006. His ACRs for a number of years were not written by his<br \/>\nsuperior officers in the P&amp;T Department. Due to this reason, it has not been possible to<br \/>\ngrant him financial up-gradation by BSNL. On a query from the Commission, he would<br \/>\nsubmit that BSNL has written a number of letters to the Department of Posts for sending<br \/>\nhis missing ACRs or, in the alternative, to write the fresh ones for the relevant years but<br \/>\nto no avail.\n<\/p>\n<p>3.      Needless to say, Amit Talwar&#8217;s problem is genuine in as much as he cannot be<br \/>\nblamed for non-recording of his ACRs. The blame must go to his superior officers. It<br \/>\nmay also be emphasised that Shri Amit Talwar is suffering financial detriment for no<br \/>\nfault of his and, therefore, BSNL needs to take all possible measures to redress his<br \/>\ngrievance.\n<\/p>\n<p>4.     In the facts and circumstances of the case, the following line of action is<br \/>\nsuggested to Shri Sasmal :-\n<\/p>\n<p>   (i)     He may take up the matter with the competent authority in P&amp;T Department<br \/>\n           once again.\n<\/p>\n<p>   (ii)    He may also follow it up with telephone calls.\n<\/p>\n<p>   (iii)   If the above two measures do not work, he may try to persuade the competent<br \/>\n           authority in BSNL to consider granting financial upgradation on the basis of<br \/>\n           Shri Talwar&#8217;s ACRs for the period he has worked in BSNL, if the rules so<br \/>\n           permit.\n<\/p>\n<p> 5.      We may add that the matter is purely departmental in nature and needs to be<br \/>\nsorted out by the Departmental authorities. We close the matter with these observations.\n<\/p>\n<p>6.     Copy of this order may also be sent to Director General, Department of Posts,<br \/>\nGovernment of India, New Delhi, with the direction to have the matter looked into at an<br \/>\nappropriate level for sending suitable response to BSNL in the matter in hand.\n<\/p>\n<p>                                                                                   Sd\/-\n<\/p>\n<p>                                                                        ( M.L.
