(J)\n\nCITATION:\n 1996 SCC  (1) 718\t  JT 1996 (1)\t111\n 1996 SCALE  (1)142\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have  heard the\t counsel for  both the parties. This<br \/>\nappeal is  directed against  the order\tof the\tCivil Judge,<br \/>\nBijapur passed on October 29, 1991 and confirmed by the High<br \/>\nCourt in  the impugned\torder made  on 5.4.1993\t in CRP\t No.<br \/>\n3565\/91. The  facts are\t clearly not in dispute. The service<br \/>\nof the\trespondent was terminated which order was ultimately<br \/>\nset aside.  The order  has  merged  with  dismissal  of\t the<br \/>\nspecial leave  petition by this Court on July 31, 1989. This<br \/>\nCourt observed thus:\n<\/p>\n<blockquote><p>     &#8220;The Management  may move the Government<br \/>\n     for reimbursement\tof the salary paid to<br \/>\n     respondent No. 1 and the Government will<br \/>\n     decide that  question according  to  law<br \/>\n     and in  the light\tof the stand taken by<br \/>\n     the University.<\/p><\/blockquote>\n<p>     In the  proceedings for  contempt, it  was held  by the<br \/>\nDivision Bench that normally the arrears of salary accrue to<br \/>\na person  whose termination  of service\t is set\t aside,\t but<br \/>\npayment depends\t upon other  factors as well. In the absence<br \/>\nof a  clear direction  while issuing  that writ,  it is\t not<br \/>\npossible to  hold that\tthe refusal  to pay  the arrears  of<br \/>\nsalary would  be an  act of contempt. Setting aside an order<br \/>\nof dismissal  creates a\t cause of action of claim arrears of<br \/>\nsalary. But  in such  case where  no direction was given for<br \/>\nthe intervening\t period,  payment  of  salary  need  not  be<br \/>\nordered, as  held by  this Court  in <a href=\"\/doc\/156294\/\">Managing Direction U.P.<br \/>\nWarehousing Corporation\t &amp; Ors.\t vs. Vijay  Narayan Vajpayee<\/a><br \/>\n[AIR 1980 SC 840].\n<\/p>\n<p>     Thereafter, it  would appeal  that the  respondent\t had<br \/>\nmoved an execution application in the District Court to give<br \/>\neffect to the order of the Tribunal which is envisaged under<br \/>\nthe Rules. Since the executing Court rejected the claim, the<br \/>\nrespondent went\t in revision  under Section  115 of  Code of<br \/>\nCivil Procedure\t which was  dismissed in  the impugned order<br \/>\ndated April 5, 1993 in CMP No. 3565\/91 by the Karnataka High<br \/>\nCourt.\tPending\t the  special  leave  petition,\t an  enquiry<br \/>\nwhether the  respondent was gainfully employed was conducted<br \/>\nand it was found that he was gainfully employed.\n<\/p>\n<p>     It is  contended by the counsel for the respondent that<br \/>\nthis appeal  has become\t infructuous. We  cannot conclude on<br \/>\nthat premise  since the\t respondent is\tclaiming back-wages.<br \/>\nThere should  be a  finding in\tthat behalf. Accordingly, we<br \/>\nheld that  the respondent is not entitled to the back-wages.<br \/>\nAs  far\t as  the  reinstatement\t is  concerned,\t it  is\t not<br \/>\nconvassed by  the learned  counsel for the appellant that he<br \/>\nis not\tentitled for  the reinstatement due to the fact that<br \/>\nthe order of dismissal was set aside and had became final.\n<\/p>\n<p>     The respondent  is entitled  to the payment of admitted<br \/>\nsalary from  the date of reinstatement. We do not propose to<br \/>\nexpress any  opinion on\t other consequential  benefits since<br \/>\nthe same is to be worked out in the light of the judgment of<br \/>\nthe Tribunal which was upheld by this Court. If the admitted<br \/>\nsalary from  the date of reinstatement is not paid, the same<br \/>\nis directed  to be  paid within\t a period of six months from<br \/>\nthe date of the receipt of this order.\n<\/p>\n<p>     The appeal is disposed of accordingly.
