The appeals \ufb01led both by the Claimant as <\/p>\n
insurance company. The M A C T, Bangalo1*f.e:” <\/p>\n
No.6164\/2005 by the judgment and-‘award ~ldat_led’lv”l_7l6;.iAOC}\u00ab6 O<\/p>\n
has awarded a compensation of   <\/p>\n
interest.\n<\/p>\n
2. The ground taken. by thye—-irisura,nce  is that<\/p>\n
the Vehicle which was  ;3:pp.ellant has been<\/p>\n
falsely impliclatedijiforlthe j\ufb02lrposelvoflclairning compensation.
\nBy referrin\u00a7–.Ex..P1,–  made by one Sri Lingaraj,<\/p>\n
learned counsel’ ‘submitted that though tractor–dowser dashed<\/p>\n
 ..whelellV\u00e9rf’the number of the said Vehicle has<\/p>\n
 the complaint. As per Ex.Pl3, case<\/p>\n
x”l’sheet, MLC was that road traffic accident was caused<\/p>\n
 he  going in a two wheeler due to skid and fall<\/p>\n
  dowr-.I_.T-The same is also referred in the case summary and<\/p>\n
O discharge card. The Claimant who has been examined as PW-<\/p>\n
nl’ ‘stated that he made a complaint as per EXP}. However the<\/p>\n
<<\/p>\n
K.\n<\/p>\n
injured did not refer the involvement of the tractor and nature
\nof the accident. In View of the above inconsistency, since the<\/p>\n
accident is in View of his own negligence due to <\/p>\n
two wheeler. only to claim compensation, this  <\/p>\n
was brought in.\n<\/p>\n
3. The learned counsel for’  the  L’<\/p>\n
accident has occurred on  and on’–the_same day
\nWithout loss of tirne, he  A.i:n’v_olVement of the
\ntractor KA 05 MB  anddriV.erV_y\\fas,charge sheeted for
\noffence under   Section l34~A 8: B of
\nthe M V  * Exilli’fdoesvlplvspeciiically refer about the tractor<\/p>\n
and therefore llthere   in the case. Ex.l3’5 IMV report<\/p>\n
:b’C-?11_’S registrationnurnbers of all the three vehicles. The<\/p>\n
tractorTcau’sedlacciclent against a two wheeler, it fell on the<\/p>\n
‘”r..,,..,anotherl’tyvo_lwlice;ler as a result the injured suffered injury<\/p>\n
 damage’:. caused to the vehicle may not be a visible<\/p>\n
‘Which is also possible in case of light touch. Hence it<\/p>\n
H  is\ufb02su’o5rnitted that what has been done by the Tribunal is just<\/p>\n
   proper calling for no interference.<\/p>\n

4. The complaint as per Ex.Pl is immediately after the
\naccident and based on the same Crime No.356\/2005 is<\/p>\n
registered by Attibele Police for the offences refer1’ed’-lfijilrthe<\/p>\n
charge sheet against the driver of the tractor.  <\/p>\n
cannot be said that the tractor was “not the<\/p>\n
accident. The IMV report though  not,.”_say <\/p>\n
accident has not been occurred,  reveals the “damage caused<\/p>\n
to the two Wheeler. It   damage
\ncould be seen when the  In the<\/p>\n
circumstances. the ‘contentions’of4’thle’f1ea.rr1ed counsel for the<\/p>\n
insurance :,company  accepted. The appeal filed by
\nthe insurance compagnylfis  dismissed.<\/p>\n
5. l\u00a7Eow_ it has’ robe seen whether the claimant is entitled<\/p>\n
 of compensation. EXP2 is the wound<\/p>\n

over scapular region.\n<\/p>\n

Xmray shows comminuted fracture of scapular
\nneck fracture of right acrimony.\n<\/p>\n
6. The Tribunal has awarded compensation:<\/p>\n
pain and agony Rs.30,000\/–. Considering the  <\/p>\n
injuries suffered and fracture, compensation’-,under \u00abtrl1is”‘heat:1<\/p>\n
needs enhancement, which is_ enhvalnced <\/p>\n
Though the claimant has produced  for<\/p>\n
Rs.38,000\/–, the clain1’ls~.y_   awarded only
\nRs.25,000\/-. There is now tribunal to
\ndisallow balance of e\u00a7\u00a7perises-\u00abTherefore, balance
\nOf RS.13,(l0.0\/9  this head. Towards<\/p>\n
conveyance and nourishment, the tribunal has awarded<\/p>\n
 which lis”en.h.anced by another sum of Rs.\u00e9l,000\/~.<\/p>\n
 _ ‘o.f”ia5ln:enities, the tribunal has awarded only<\/p>\n
 is on the lower side and the same is<\/p>\n
.ll_lf.enl:anced ”  another sum of Rs.10,000\/–. Hence the<\/p>\n
 entitled to enhanced compensation of Rs.42,000\/-<\/p>\n
shall carry interest at 6% per annum. The appeal filed<\/p>\n
