Justice K.T.SANKARAN\n\n Dated :08\/12\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.36656 OF 2010\n          ------------------------------\n                     th\n      Dated this the 8  day of December, 2010\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The  petitioner  was  appointed  as  Full Time<\/p>\n<p>Sanskrit Teacher in Azhikode West U.P.School with<\/p>\n<p>effect from 1.6.2010 against a retirement vacancy.<\/p>\n<p>The Manager submitted the proposal for approval of<\/p>\n<p>appointment to the Educational Officer.     As per<\/p>\n<p>Ext.P2 staff fixation order for the academic year<\/p>\n<p>2010-2011, the Full Time post of Sanskrit was<\/p>\n<p>reduced to Part Time post on the ground that it is<\/p>\n<p>an uneconomic school.  The case of the petitioner<\/p>\n<p>is that the Full Time post of Sanskrit teacher was<\/p>\n<p>created by way of Group C diversion, as per Ext.P3<\/p>\n<p>staff fixation order for 1991-92.      It is also<\/p>\n<p>submitted    that    in     view    of     G.O.(Ms)<\/p>\n<p>No.371\/2000\/G.Edn. dated 13.11.2000 (Ext.P4), the<\/p>\n<p>reduction of the post to Part Time post was not<\/p>\n<p>proper.  Challenging the staff fixation order for<\/p>\n<p>2010-2011, the petitioner filed Ext.P5 revision<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.36656 OF 2010    2<\/span><\/p>\n<p>dated   4.11.2010    before  the  Director  of  Public<\/p>\n<p>Instruction. Ext.P5 is pending disposal.<\/p>\n<p>    2.Though several reliefs are claimed in the<\/p>\n<p>Writ   Petition,     the  learned   counsel  for   the<\/p>\n<p>petitioner submitted that for the time being, it<\/p>\n<p>would be sufficient, if Ext.P5 revision is directed<\/p>\n<p>to be considered expeditiously.<\/p>\n<p>    3. Heard the learned counsel for the petitioner<\/p>\n<p>and the learned Government Pleader.<\/p>\n<p>    Taking into account the facts and circumstances<\/p>\n<p>of the case, the Writ Petition is disposed of<\/p>\n<p>directing the Director of Public Instruction to<\/p>\n<p>consider   and   dispose   of  Ext.P5  revision  dated<\/p>\n<p>4.11.2010     submitted    by   the   petitioner,   as<\/p>\n<p>expeditiously as possible, and at any rate, within<\/p>\n<p>a period of two months from the date of receipt of<\/p>\n<p>a  copy    of   the   judgment,  after  affording   an<\/p>\n<p>                                                    th<br \/>\nopportunity of being heard to the petitioner and 4<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.36656 OF 2010   3<\/span><\/p>\n<p>respondent Manager. The petitioner shall produce a<\/p>\n<p>copy of the Writ Petition and a certified copy of<\/p>\n<p>the   judgment    before  the   Director  of   Public<\/p>\n<p>Instruction.
