it  Section 138 of the Negotiable liistrumeiiis Act. was not (‘()111pliCCl.<\/p>\n

<1. Cognizanee was taken for the. offence. under Section .138
\nof the Negotiable Instruments Act and t.he petitioner was<\/p>\n
summoned to answer the charge. he pleaded not guilty.<\/p>\n
Consequent to which he was put to trial. During _wh4ich;r-'lt~h"e:V.<\/p>\n
complainant, examined herself as PW} and placed"-reliancelion: <\/p>\n
ten documents. while the accused also::t:end"ered~;th.e as":<\/p>\n
DW}. and examined two witnesses. Consv_i_derii1g the-~_. e'vide1t1e,e'–spo'~_<\/p>\n
brought. on record. the learned T1'ia},Jtsdge fouiidra.ic'on'iplai'nant's V<\/p>\n
evidence out weighed the 'deifence'llar'1d;eon\u00a7equen'tly~"convicted
\nhim for the offence under   r\ufb01ill\ufb01 N\u00e9igotiabie
\nInstruments Act and  a of Rs.3.00.000\/~
\nas fine.  "\u00abfijrinii.nallllAppeal No.95\/2007<\/p>\n
reiterating–._plea oltl'ef.in–nocerice\u00a7-which did not find favour. The<\/p>\n
learned Applellpate  the appeal. Against both the<\/p>\n
judgments, he is inarevisioii.\n<\/p>\n

 -J2.’ Th’e:”vtals’s.ert,ive contention against the impugned<\/p>\n
T’<\/p>\n
V judgrnenlts  there is no material evidence establishing<\/p>\n
 ‘ existence.’ of: debt or liability between the respondent and the<\/p>\n
 ll petitioin_er; that the transaction if any was between the petitioner<\/p>\n
 Dinesh Shetty. The issuance of cheque was under<\/p>\n
“duress and was not v0Eu.nt”arily done. The cheque has been<\/p>\n
obtained under fraud and duress and hence they were<\/p>\n
unenforceable against: the petitioner.\n<\/p>\n

6. Per Contra. learned Counsel for t.he respondent
\nsupports the impugned judgments contending’ that. the money<\/p>\n
lending transaction between the parties is documented t.hi”~-ough<\/p>\n
the statement of accounts of ICICI Bank and that    _<\/p>\n
liability of the petitioner.\n<\/p>\n
7. Keeping in mind these aspects, l–._haVel’examinettT”thVe’..<\/p>\n
material made available in supplen’ten*t:ation’ to t’hetr._corite’nti’ons. ”<\/p>\n
8. Though the respond–e11t;.sAVl”assert.iyely urged that.
\nimpugned cheques Aywere issuerd the-.v.’reVjs;po~11dent towards<\/p>\n
repayment of  petitione–r denied it. Against<\/p>\n
the said :’denial…:1i?ve ‘l’i1i’cl ‘l”t1pn-co1ttrav’erted document ie, the
\nstatement of  ICICI Bank relating to the<\/p>\n
account maintained by, the complainant–~respondent. The<\/p>\n
statenv.ieht3_ol’t a_ccottntvv.ev.i\u00abdences the fact. that, the respondent<\/p>\n
hadsissnedcheques in favour of the petitioner totaling to a sum<\/p>\n
   of   uSince the cheque of the complainant has been<\/p>\n
 encashed by the petitioner. in the absence of any material<\/p>\n
  eiftdpehee, it has to be accepted that the petitioner has withdrawn<\/p>\n
 “the”:an1ount covered under the cheques issued in his name by<\/p>\n
hrthve\ufb02respondent. It also compels the petitioner to explain under<\/p>\n
ah the circumstances and in relation to what. t1’ansact.ion he had<\/p>\n
received the said amount. The accused has failed to explain. but<\/p>\n
ya<\/p>\n

on the other hand has referred to one Dinesh Shetty. According<\/p>\n
to him, the complainant had paid amount to him t.o be passed<\/p>\n
on to Dinesh Shetty with whom she had subscribed to a chit. if<\/p>\n
we believe this contention. then Dinesh Shetty should have\u00bb. been<\/p>\n
a material witness. The petitioner did not venture__tjo”‘st1.’m._nIo:n <\/p>\n
him on his own’ or with court assistance to S\u20acCL1f\u20ac\u00bb,.f’l.’i’SVpIi\u00e9S\u20acl1C’e” <\/p>\n
to tender evidence. Therefore. the plea has jj.re1;11ained’r.a~.,_pleaf<\/p>\n
without transferring into a va’.’.id_ defeiice.  the <\/p>\n
respondent is concerned. the statenient of aceotziits filed by her
\nis a clincher to establish vi’ne’t:_1uIn between the parties of money
\nlending and in the absence of “any  ‘;5_1*e_slum13tio11 under<\/p>\n
Section 139 is ;’a’\\2a;.iVl:eable;i._ to  favour of the<\/p>\n
eornplainant. _ .\n<\/p>\n
9. I am ‘satitsfield   trial Court as also the Appellate<\/p>\n
‘Court  right iunwtlheir conclusion that. the primary burden<\/p>\n
 ‘clislcliarged\u00e9 by the Complainant”. to establish the allegations<\/p>\n
in  it is the accused who had failed to rebut<\/p>\n
lithe presurnption against him and also failed to establish his<\/p>\n
\u00b0’v.defe1:1ce. ‘here is a concurrent finding on facts and this is<\/p>\n
revi’s_io1~1-Vuridei’ Section 397 with its scope being very narrow.<\/p>\n
drirowever. for ascertaining as to where the injustice has been<\/p>\n
“done or any material evidence has been ignored by the Trial<\/p>\n
Court, 1 have even looked into the evidence and I am satisfied<\/p>\n
