DHANGAR DEPUTY RNGINEER (O&amp;M) - Petitioner(s)\n \n\nVersus\n \n\nCHANDRAVATIBEN\nMAHESHBHAI &amp; 1 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n:\n \n\n \nMS\nLILU K BHAYA for\nPetitioner(s) : 1, \nMR ASHUTOSH R BHATT for Respondent(s) : 1, \nMS\nBHAVIKA KOTECHA, AGP for Respondent(s) : 2 IN SCA 4662\/2008,\n \n\n \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/09\/2008 \n\n \n\n \n \nCOMMON\nORAL ORDER<\/pre>\n<p>As<br \/>\n\tin all the matters, common questions arise for consideration, they<br \/>\n\tare being considered by this common order.\n<\/p>\n<p>The<br \/>\n\tpetitioner   Electricity Company, by the present petitions, has<br \/>\n\tchallenged the order passed by the Electrical Inspector and the<br \/>\n\tappellate Authority, whereby he has reduced the bill on the basis of<br \/>\n\tthe actual consumption by applying difference and the penalty is<br \/>\n\tproportionately reduced to that extent.\n<\/p>\n<p>Heard<br \/>\n\tMs.Bhaya, learned Counsel for the petitioner, Mr.Bhatt, learned<br \/>\n\tCounsel appearing for the private parties and Ms.Kotecha, learned<br \/>\n\tAGP for the Electrical Inspector and the appellate Authority.\n<\/p>\n<p>The<br \/>\n\tcontention raised on behalf of the petitioner is that it was not<br \/>\n\topen to the appellant authority to reduce the amount of charges per<br \/>\n\tunit by giving &#8216;set off&#8217; to the rates already paid by the person<br \/>\n\tconcerned for industrial connection, nor was it open to the<br \/>\n\tappellate authority to apply penalty at 0.5 time i.e. 50% as against<br \/>\n\t1.5 times penalty, which is prescribed by the statute and,<br \/>\n\ttherefore, it was submitted that there are errors committed apparent<br \/>\n\ton the face of record, which may be interfered with.\n<\/p>\n<p>Whereas<br \/>\n\ton behalf of the private respondents, the contention raised is that<br \/>\n\tit was a bonafide mistake of the employee of the respondent No.1<br \/>\n\tand, therefore, keeping in view the said circumstances as it was a<br \/>\n\tbonafide mistake, the power is exercised.\n<\/p>\n<p>Having<br \/>\n\tconsidered the above, it deserves to be recorded that the<br \/>\n\tconsumption of the units as provided under Sub-section (5) is by way<br \/>\n\tof presumption and, therefore, if it is found by the Electrical<br \/>\n\tInspector\/Appellate Authority, otherwise, there is no absolute<br \/>\n\tproposition that it must be charged for six months, preceding the<br \/>\n\tdate of the inspection.  Instead of the same, in the present case,<br \/>\n\tthe period counted is of six months by the appellate authority.\n<\/p>\n<p>Further,<br \/>\n\tin Sub-section (6) of Section 126, assessment is to be made at the<br \/>\n\trate equal to 1.5 times of the tariff applicable, but while applying<br \/>\n\tthe tariff, if the tariff rate already paid is given &#8216;set off&#8217; and<br \/>\n\tkeeping in view the proportion of the difference between the tariff<br \/>\n\tof the industrial use and the tariff of the commercial use, the<br \/>\n\tpenalty applied is at 0.5 times, since it is found that it was a<br \/>\n\tbonafide mistake of the consumer, such an approach on the part of<br \/>\n\tthe appellate Authority cannot be said as perverse, which may call<br \/>\n\tfor interference by this Court in exercise of the power under<br \/>\n\tArticle 227 of the Constitution of India.\n<\/p>\n<p>In<br \/>\n\tview of the above, no case is made out for interference.
