SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CIVIL APPEAL NO.      1867            2008<br \/>\n(Arising out of S.L.P. (C) No.25804 of 2004)<\/p>\n<p>Dr. ARIJIT PASAYAT, J<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order of the Division<br \/>\nBench of the of the Karnataka High Court dismissing the writ<br \/>\nappeal filed  under Section 4 of the Karnataka High Court Act.<br \/>\nChallenge in the writ appeal was to the order passed by a<br \/>\nlearned Single Judge.   The dispute relates to applicability of<br \/>\nthe Karnataka Land Reforms Act, 1961 (in short the &#8216;Act&#8217;) in<br \/>\nthe background of Mysore (Personal and Miscellaneous) Inam<br \/>\nAbolition Act, 1954 (in short &#8216;Inam Act&#8217;) as amended by the<br \/>\nKarnataka Inams Abolition Laws (Amendment) Act, 1979 (in<br \/>\nshort &#8216;Amendment Act&#8217;).\n<\/p>\n<p>3.\tThe factual controversy lies in a very narrow compass.\n<\/p>\n<p>\tAppellant had filed the writ petition no.32930 of 1996<br \/>\nwhich was disposed of by orders dated August 4, 2000 and<br \/>\nAugust 24, 2000.  By the latter order the following directions<br \/>\nwere given:\n<\/p>\n<p>&#8220;Even with regard to the question as to<br \/>\nwhether the lands in question are Inam lands<br \/>\nor not, it is impossible for me to form a correct<br \/>\nimpression because each of the learned<br \/>\nAdvocates is making a different statement.<br \/>\nThe Tribunal shall first ascertain whether, the<br \/>\nlands in question are imams lands and if the<br \/>\nanswer is in the affirmative, then the Tribunal<br \/>\nshall forward the records to the Special Deputy<br \/>\nCommissioner who shall give notice to the<br \/>\nparties, hear them and decide the case. If<br \/>\nhowever, the Tribunal does have jurisdiction in<br \/>\nlaw to entertain the proceeding insofar as, if<br \/>\nthe lands are not inam lands then the Tribunal<br \/>\nshall proceed to do so.&#8221;\n<\/p>\n<p>4.\tIt is the case of the appellant that the Land Tribunal did<br \/>\nnot consider this aspect and did not also record any finding<br \/>\nand came to an abrupt conclusion as follows:\n<\/p>\n<p>&#8220;The Gattarlahally was the jodi village, after<br \/>\nabolition, it is vest to the Government and not<br \/>\na Inam land.&#8221;\n<\/p>\n<p>5.\tBefore the learned Single Judge the specific stand<br \/>\nrelating to the jurisdiction was disposed of with the following<br \/>\nobservations:\n<\/p>\n<p>&#8220;After hearing the learned counsel for the<br \/>\nparties, I have examined the correctness of the<br \/>\nfindings and reasons recorded in the impugned<br \/>\norder by the Land Tribunal on the contentious<br \/>\npoints. In my considered view, none of the<br \/>\ncontentions urged in this petition warrant<br \/>\ninterference with the impugned order for the<br \/>\nreason that, the order passed by the Special<br \/>\nDeputy Commissioner under the Act of 1954<br \/>\ndoes not bind third respondent as he was not<br \/>\nparty to the proceedings.  Further, in view of<br \/>\nsub-section (1) of Sec.44 of Act<br \/>\nnotwithstanding the order of the Special<br \/>\nDeputy Commissioner, Act of 1\/74 has come<br \/>\ninto force, it is a tenanted land and therefore it<br \/>\nwill statutorily vests with the State<br \/>\nGovernment.  Thereafter, consequences as<br \/>\nenumerated under sub-section (2) of Sec.44<br \/>\nwill come into operation. Further, the<br \/>\ncontention urged that Form No.7 application is<br \/>\nnot maintainable as urged above in this<br \/>\npetition are wholly untenable in law for the<br \/>\nreason that submissions made on behalf of<br \/>\nthird respondent is well founded in place<br \/>\nreliance upon the provisions of KLRF Act and<br \/>\nalso in view of Muniyellapa vs. B.M. Krishna<br \/>\nMurthy reported in AIR 1992 SC 205 and the<br \/>\nsame is accepted.  Therefore, contention urged<br \/>\non behalf of petitioner in this regard placing<br \/>\nreliance upon the decisions of this Court are<br \/>\nwholly untenable in law and the same is<br \/>\nrejected.  Further the reliance placed upon<br \/>\nRangaiah&#8217;s case is wholly in-applicable to the<br \/>\nfact situation and is misconceived.  Hence,<br \/>\nreliance placed upon the said Judgment are<br \/>\nmisplaced and the contention in this regard is<br \/>\nrejected.&#8221;\n<\/p>\n<p>6.\tLearned Single Judge only observed that since the<br \/>\nrespondent was not party to the proceeding, the order passed<br \/>\nby the Special Deputy Commissioner under the 1954 Act was<br \/>\nof no consequence and even otherwise the consequences as<br \/>\nenumerated in Section 44(2) came into operation.  The<br \/>\nDivision Bench did not analyse the issue in detail and upheld<br \/>\nthe view of the learned Single Judge.\n<\/p>\n<p>7.\tThe specific ground has been raised in this appeal that<br \/>\nquestion of jurisdiction of the Land Tribunal to reopen a case<br \/>\nand decide by the Special Deputy Commissioner for Inams<br \/>\nAbolition has not been dealt with.  Reference has been made to<br \/>\nSection 141 of the Act.\n<\/p>\n<p>8.\tLearned counsel for the respondent submitted that<br \/>\nthough it has not been specifically dealt with, the factual<br \/>\nscenario clearly shows that no relief has been granted to the<br \/>\nappellant.\n<\/p>\n<p>9.\tOn the earlier occasion, the learned Single Judge has<br \/>\nspecifically stated that the question of jurisdiction of the<br \/>\nTribunal has to be dealt with as quoted above. This apparently<br \/>\nhas not been done by the Land Tribunal, and learned Single<br \/>\nJudge and the Division Bench lost sight of these relevant<br \/>\naspects.\n<\/p>\n<p>10.\tIn the circumstances, the impugned orders of the learned<br \/>\nSingle Judge and the Division Bench of the High Court are<br \/>\nquashed and the matter is remitted to the learned Single<br \/>\nJudge to deal with the issue in accordance with law.\n<\/p>\n<p>11.\tThe appeal is disposed of with no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Venkateshappa vs State Of Karnataka &amp; Ors on 10 March, 2008 Author: .
