Justice V.RAMKUMAR\n\n Dated :20\/09\/2010\n\n O R D E R\n                        V.RAMKUMAR, J.\n             ----------------------------------------------\n             Bail Application No.5632 of 2010\n            ------------------------------------------------\n        Dated this the 20th day of September, 2010\n\n                               ORDER\n<\/pre>\n<p>      The petitioners, who are accused Nos.2 to 6 in Crime<\/p>\n<p>No.857\/2010 of Kilikolloor Police Station for an offence<\/p>\n<p>punishable under Section 420 I.P.C. seek anticipatory bail.<\/p>\n<p>      2.   The    learned     Public     Prosecutor      opposed the<\/p>\n<p>application.\n<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case of<\/p>\n<p>this nature. But at the same time, I am inclined to permit the<\/p>\n<p>petitioners to surrender before the Investigating Officer for<\/p>\n<p>the purpose of interrogation and then to have their application<\/p>\n<p>for bail considered by the Magistrate having jurisdiction.<\/p>\n<p>Accordingly, the petitioners shall surrender before the<\/p>\n<p>investigating officer on 29\/9\/2010 or on 30\/9\/2010 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. The petitioners shall thereafter be produced<\/p>\n<p>before the Magistrate concerned and file an application for<\/p>\n<p>regular bail.    On being convinced that the petitioners have<\/p>\n<p>been interrogated by the police, the Magistrate shall<\/p>\n<p>preferably on the same date on which the application is filed,<\/p>\n<p>Bail Appln.No.5632\/2010<br \/>\n<span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>release the petitioners on bail on each of the petitioners<\/p>\n<p>executing a bond for Rs.15,000\/- (Rupees fifteen thousand<\/p>\n<p>only) with two solvent sureties each for the like amount to the<\/p>\n<p>satisfaction of the Magistrate and subject to the following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>              1.    The petitioners shall report before the<\/p>\n<p>                    Investigating Officer between 9 a.m. and<\/p>\n<p>                    11 a.m. on all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><p>              2.    The petitioners shall make themselves<\/p>\n<p>                    available    for    interrogation including<\/p>\n<p>                    custodial   interrogation   as   and  when<\/p>\n<p>                    required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>              3.    The petitioners shall not influence or<\/p>\n<p>                    intimidate the prosecution witnesses nor<\/p>\n<p>                    shall they attempt to tamper with the<\/p>\n<p>                    evidence for the prosecution.<\/p>\n<\/blockquote>\n<blockquote><p>              4.    The petitioners shall not commit any<\/p>\n<p>                    offence while on bail.\n<\/p><\/blockquote>\n<blockquote><p>              5.
