NO.18199 OF 2010\n             ----------------------------------------------\n           Dated this the 11th day of June, 2010.\n\n                            JUDGMENT\n<\/pre>\n<p>     The petitioner has approached this Court seeking for<\/p>\n<p>the following reliefs:\n<\/p>\n<blockquote><p>      (i) issue a writ of certiorari or any other writ, order or<br \/>\n      direction calling for the records leading to Ext.P1 to P5<br \/>\n      and set aside Ext.P1 and P2 finding that the 1st<br \/>\n      respondent has no authority        to issue those as 1st<br \/>\n      respondent is not rendering any service to the petitioner<br \/>\n      Juma Masjid;\n<\/p><\/blockquote>\n<blockquote><p>      (ii) declare that, the 1st respondent has no authority to<br \/>\n      demand contribution from the petitioner under Section<br \/>\n      72 of the Wakf Act as the petitioner&#8217;s net annual income<br \/>\n      is far below the statutory       amount fixed for paying<br \/>\n      contribution;\n<\/p><\/blockquote>\n<blockquote><p>      (iii) declare that the proceedings initiated under<br \/>\n      Revenue Recovery       Act pursuant to the issuance of<br \/>\n      Exts.P1 &amp; P2 as illegal;\n<\/p><\/blockquote>\n<blockquote><p>      (iv) pass such other writ, order or direction as prayed for<br \/>\n      by the petitioner in due course which shall be just and<br \/>\n      proper;<\/p><\/blockquote>\n<p>     2. The learned standing counsel appearing for the 1st<\/p>\n<p>respondent submits that there is a statutory remedy as<\/p>\n<p>provided under Section 72 of the Wakf Act, 1995 and that<\/p>\n<p>petitioner has approached this Court without exhausting the<\/p>\n<p><span class=\"hidden_text\">W.P.(C). NO.18199 OF 2010     2<\/span><\/p>\n<p>same.\n<\/p>\n<p>     3. Heard learned Government Pleader as well.<\/p>\n<p>     4. The learned counsel appearing for petitioner<\/p>\n<p>submits that the petitioner is constrained to approach this<\/p>\n<p>Court because of the coercive steps, as evident from Ext.P4<\/p>\n<p>and P5 notices issued under the Revenue Recovery Act.<\/p>\n<p>The learned counsel also submits that petitioner is intending<\/p>\n<p>to pursue the statutory remedy, for which some breathing<\/p>\n<p>time may be provided.\n<\/p>\n<p>      5. After hearing both sides, this Court finds it fit and<\/p>\n<p>proper to permit the petitioner to avail the statutory remedy,<\/p>\n<p>if the same is pursued within two weeks from the date of<\/p>\n<p>receipt of copy of this judgment, on which event, the same<\/p>\n<p>shall be treated as proper and valid appeal and appropriate<\/p>\n<p>orders    shall be passed   by the 1st respondent Board in<\/p>\n<p>accordance with law, as expeditiously as possible, at any<\/p>\n<p>rate, within 6 weeks thereafter. It is made clear that, further<\/p>\n<p>coercive      steps stated as being pursued against the<\/p>\n<p>petitioner, as evident from Ext.P3 and P4, shall be kept in<\/p>\n<p><span class=\"hidden_text\">W.P.(C).
