S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\ncontroversy relates to an error in the Revenue records.  The writ<br \/>\npetition &#8211;  SCA No. 3476 of 2009 was dismissed by the learned Single<br \/>\nJudge without any ground, without recording the grievance, merely on<br \/>\nthe basis of statement made by learned AGP and orders passed by<br \/>\ndifferent authorities were set aside on 13.5.2009.\n<\/p>\n<p>2.\tAgainst<br \/>\nthe said order, State Government preferred  LPA No. 2234 of 2009,<br \/>\nwherein the Division Bench by order dated 25.2.2010 observed that<br \/>\nends of justice shall be met if the Ahmedabad District Collector<br \/>\ncarries out the rectification procedure as directed by the learned<br \/>\nSingle Judge, keeping in view the relevant records, and the appeal<br \/>\nwas dismissed with the aforesaid observation.\n<\/p>\n<p>3.\tAfter<br \/>\nDivision Bench order,  the Collector, Ahmedabad passed  order on<br \/>\n10.6.2010.   The petitioner applied for a copy of the said order, but<br \/>\nhis grievance is that even after 3 months the said order and other<br \/>\nrecords have not been supplied.  The Misc. Civil Application has been<br \/>\ntherefore preferred by the petitioner to direct the Collector not to<br \/>\nimplement the  order dated 10.6.2010 with further prayer to recall<br \/>\nlast portion of the order dated 25.2.2010 passed in LPA No. 2234 of<br \/>\n2009, whereby the Division Bench  ordered to take correctional<br \/>\nmeasures within six months.\n<\/p>\n<p>4.\tCounsel<br \/>\nappearing on behalf of the petitioner would contend that the<br \/>\nCollector hurriedly passed order on 10.6.2010, without giving proper<br \/>\nopportunity to the petitioner and such illegal order has been passed<br \/>\nhurriedly only because of observation of Division Bench dated<br \/>\n25.2.2010.\n<\/p>\n<p>5.\tOn<br \/>\nhearing the counsel for the parties and from the record, it will be<br \/>\nevident that the petitioner preferred the writ petition   SCA No.<br \/>\n7476 of 2009, wherein the Court set aside the order on the basis of<br \/>\nstatement made by learned AGP and the Collector, Ahmedabad was<br \/>\ndirected to initiate appropriate action to rectify the error in<br \/>\naccordance with law.  The said order has not been challenged by the<br \/>\npetitioner and that he is happy with the order.  The Division Bench<br \/>\ndismissed the appeal and confirmed the said order.  In this<br \/>\nbackground, the question of recalling last portion of the order dated<br \/>\n25th Feb. 2010 does not arise, which will amount to<br \/>\nalteration of the order passed by the learned Single Judge in the<br \/>\nwrit petition preferred by the petitioner, which reached finality.<br \/>\nIf petitioner is not happy with one or other order, he may move<br \/>\nbefore appropriate forum.  The Misc.
