Justice P.S.GOPINATHAN\n\n Dated :26\/03\/2009\n\n O R D E R\n            P.R.RAMAN &amp; P.S.GOPINATHAN, JJ.\n\n             -----------------------------------------------\n                     W.P(C).No.2480 of 2008\n             -----------------------------------------------\n               Dated this the 26th March, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>Raman, J.\n<\/p>\n<p>      The matter relates to construction of a monumental gate<\/p>\n<p>to the park in the Thekkinkadu Maidan. The Thrissur<\/p>\n<p>Corporation, is the licensee of the area, which is surrounded<\/p>\n<p>by a compound wall. They started construction of the<\/p>\n<p>monumental gate in the place of an old one, which give rise to<\/p>\n<p>the present complaint and the Writ Petition. It is alleged that<\/p>\n<p>this is a permanent construction, and placing reliance on some<\/p>\n<p>judgments of this Court, it is contended by the petitioner that<\/p>\n<p>such constructions are prohibited by this Court. The<\/p>\n<p>Corporation, on the other hand, would contend that this is not<\/p>\n<p>a construction in strict sense. It is an archaeological gate. In<\/p>\n<p>its place there was another gate which is part of the<\/p>\n<p>beautification of the city. Since this is a land belonging to the<\/p>\n<p>Cochin Devaswom Board, in the absence of any sanction<\/p>\n<p>obtained from the Devaswom Board, construction could not<\/p>\n<p>have been proceeded with. Hence, we directed the Thrissur<\/p>\n<p>Corporation to make an application in that behalf to the Board,<\/p>\n<p><span class=\"hidden_text\">  WP(C).2480\/09                  2<\/span><\/p>\n<p>whereupon the Cochin Devaswom Board will consider the<\/p>\n<p>same. We recorded in our order dated 19.2.2009 that the<\/p>\n<p>Devaswom       Board   accorded    sanction  imposing      certain<\/p>\n<p>conditions and the Corporation will complete the construction<\/p>\n<p>after strictly complying with the conditions so stipulated. Now<\/p>\n<p>the construction is over.\n<\/p>\n<p>      2. In the facts and circumstances of the case, we do find<\/p>\n<p>that the construction so made is only a gate in replacement of<\/p>\n<p>the existing one will not in any way be considered as<\/p>\n<p>objectionable construction. Further it is a public park which<\/p>\n<p>is to be closed during night. Whether the construction is done<\/p>\n<p>in accordance with the conditions is a matter which the Board<\/p>\n<p>may verify. If there is any violation of conditions, it is open to<\/p>\n<p>the Board to take up the matter.
