SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/02\/2010 \n\n \n\n \nCAV\nORDER \n<\/pre>\n<p>1.\tPresent<br \/>\napplication has been preferred by the applicants -original appellants<br \/>\nof Appeal from Order No. 292 of 2007 to restore the said Appeal from<br \/>\nOrder No. 292 of 2007 to file, which came to be dismissed for non<br \/>\nprosecution by order dated 7th August, 2008 as though the<br \/>\nmatter was adjourned on number of occasions earlier, learned advocate<br \/>\nappearing on behalf of the applicants was absent and since more than<br \/>\none year and six months there was no relief in favour of the<br \/>\napplicants- original appellants.\n<\/p>\n<p>2.\tShri<br \/>\nSB Vakil, learned Senior Advocate has appeared with Shri BM<br \/>\nMangukiya, learned advocate for the applicants-original appellants.<br \/>\nIt is submitted by Shri Vakil, learned Senior Advocate for the<br \/>\napplicants that the day on which the Appeal from Order was dismissed<br \/>\nfor non prosecution, the same was dismissed for non prosecution on<br \/>\nthe first call itself and it is the normal practice of this Court<br \/>\nthat in the first call the matter is kept back. It is further<br \/>\nsubmitted that even Shri Mangukiya, learned advocate for the<br \/>\napplicants made an arrangement and his junior  was to mention before<br \/>\nthe Court to keep the matter back as Shri Mangukiya, learned advocate<br \/>\nfor the applicants was busy in another Court, however his junior also<br \/>\ndid not remain present at the time when the matter was called out. It<br \/>\nis submitted that as one of learned advocate for the respondent was<br \/>\non sick note, learned advocate for the applicants was of the opinion<br \/>\nthat the matter would be adjourned in view of sick note of Ms.<br \/>\nDawawala, learned advocate for the respondent no. 6 and therefore, he<br \/>\ndid not remain present at the time when the matter was called out.<br \/>\nTherefore, it is requested to allow present Miscellaneous Civil<br \/>\nApplication  and to restore the Appeal from Order to file.\n<\/p>\n<p>3.\tShri<br \/>\nVakil, learned Senior Advocate for the applicants has relied upon the<br \/>\ndecision of the Hon&#8217;ble Supreme Court in the case of Rafiq and<br \/>\nanother vs. Munshilal and another<br \/>\nreported in AIR 1981 SC 1400<br \/>\nin support of his submission that for the negligence and\/ or default<br \/>\non the part of advocate litigant should not be made to suffer. It is<br \/>\nsubmitted by Shri Vakil, learned Senior Advocate for the applicants<br \/>\nthat, in the case of Rafiq and another (supra),<br \/>\nAppeal from Order was restored to file on imposing cost, which was<br \/>\ndirected to be paid by the learned advocate for the applicants,<br \/>\nhowever in the present case there is no question of even imposing the<br \/>\ncost upon the advocate. Therefore, it is requested to allow present<br \/>\napplication.\n<\/p>\n<p>4.\tApplication<br \/>\nis opposed by Shri SS Belsare, learned advocate for the respondent<br \/>\nno.1 and Shri NM Kapadia, learned advocate for the respondent no. 2.<br \/>\nIt is submitted that no case is made out to restore the Appeal from<br \/>\nOrder to file. It is submitted that as such the Appeal from Order was<br \/>\nadjourned at least for 28 times earlier and even the order below<br \/>\nNotice of Motion impugned in the said Appeal from Order was passed as<br \/>\nfar as back in the month of February 2007 and no interim relief was<br \/>\nobtained by the applicants for more than one year and eight months<br \/>\nand the Appeal from Order came to be adjourned for more than 28 times<br \/>\nmostly due to non availability of the learned advocate for the<br \/>\napplicants and only thereafter<br \/>\nthe Appeal from Order came to be dismissed for non prosecution. It is<br \/>\nsubmitted that when the  Appeal from Order was dismissed for non<br \/>\nprosecution on 7.8.2008, the learned advocate for the applicants was<br \/>\noutside the Court Room and despite having come to know about the<br \/>\ndismissal of Appeal from Order for non prosecution, he even did not<br \/>\ncare to enter the Court Room and requested to restore the Appeal from<br \/>\nOrder on that very day. It is further submitted that even the<br \/>\nreasoning given by the applicants in the present application and the<br \/>\nsubmissions made by the learned Senior Advocate for the applicants<br \/>\nare self contradictory. It is submitted that it is stated in the<br \/>\napplication that learned advocate for the applicant Shri Mangukiya<br \/>\nwas actually arguing matter before another Court and at the same time<br \/>\nit is the case on behalf of the applicants that the advocate of the<br \/>\napplicant was under the bonafide  belief that since the advocate for<br \/>\nthe respondent no.6 Ms. Dawawala had filed a sick note, the matter<br \/>\nwould be adjourned and therefore, he did not remain present. It is<br \/>\nsubmitted that both the aforesaid are self contradictory. It is<br \/>\nsubmitted that the decision relied upon by the learned advocate for<br \/>\nthe applicants will not be of any assistance in the peculiar facts<br \/>\nand circumstances of the case. Therefore, it is requested to dismiss<br \/>\nthe present  application.\n<\/p>\n<p>5.\tHeard<br \/>\nthe learned advocates for the respective parties<br \/>\nat length. At the outset, it is required to be noted that in the<br \/>\nAppeal from Order the applicants herein-original appellants have<br \/>\nchallenged the order passed below Notice of Motion passed by the<br \/>\nlearned City Civil Court, Ahmedabad which has been passed  in the<br \/>\nmonth of February, 2007 and by the said order passed  below Notice of<br \/>\nMotion the learned Chamber Judge of the City Civil Court, Ahmedabad<br \/>\nhas restrained the original defendants No. 1 to 4 i.e. Harjibhai<br \/>\nKaramsibhai Desai and one Shri Parshottambahi Pitroda from acting as<br \/>\na Trustee of Vitthal Mandir Trust, Bhadra Ahmedabad and despite the<br \/>\nabove the appellant No. 2 Vitthal Mandir Trust is represented through<br \/>\nsaid Harjibhai Karamsibhai as Managing Trustee of the Vitthal Mandir<br \/>\nTrust despite the injunction operative against him. Be that it may,<br \/>\nthe facts remain that  the order passed in February 2007 below Notice<br \/>\nof Motion has been challenged in the main Appeal from Order which is<br \/>\nof the year 2007. The said Appeal from Order came to be adjourned for<br \/>\nat least 27 times and mostly due to non availability of the learned<br \/>\nadvocate for the applicants- original appellants. Before the matter<br \/>\nwas notified on 7.8.2008, the Appeal from Order was required to be<br \/>\nadjourned on as Shri Mangukiya, learned advocate for the applicants<br \/>\ntook time as he was not having the papers and considering the fact<br \/>\nthat Appeal from Order is of the year 2007 and still pending for<br \/>\nadmission hearing, this Court reluctantly granted time in the<br \/>\ninterest of justice. Thereafter the Appeal<br \/>\nfrom Order was taken up for admission hearing on 7.8.2008 and again<br \/>\nthe learned advocate for the applicants did not remain present and in<br \/>\naforesaid facts and circumstances this Court was constrained to<br \/>\ndismiss the aforesaid Appeal from Order for non prosecution as<br \/>\nearlier the Appeal from Order was adjourned for at least for 27 times<br \/>\nand the Appeal from Order challenging the order below Notice of<br \/>\nMotion passed in February 2007 was pending for admission hearing till<br \/>\n7.8.2008. Despite adjourning the matter for at least 27 times when<br \/>\nthe learned advocates for the applicants remained absent what another<br \/>\norder can be passed ? When everybody is talking about the delay and<br \/>\narrears  and the blame is upon Courts that there is a delay in the<br \/>\nCourts, nobody is knowing the real reason for delay and arrears in<br \/>\nthe Court. As such considering the facts of the case on hand, the<br \/>\nadvocate is responsible for such a delay and arrears in the Court.<br \/>\nUnder the circumstances and in facts and circumstances of the case,<br \/>\nit can be said that order passed by this Court dismissing the Appeal<br \/>\nfrom Order for non prosecution   after adjourning the matter at least<br \/>\n27 times  is unreasonable and \/ or unwarranted.\n<\/p>\n<p>6.\tNow,<br \/>\nso far as the contention on behalf of the applicants that it was the<br \/>\nfirst call on 7.8.2008  and therefore, on the first call the Appeal<br \/>\nfrom Order could not have been dismissed for non prosecution cannot<br \/>\nbe accepted. There is no such hard and<br \/>\nfast rule and \/ or practice that in the first call the matter cannot<br \/>\nbe dismissed for non prosecution, it depends upon the facts of each<br \/>\ncase. When on earlier last occasion when reluctantly this Court<br \/>\nadjourned the matter as the learned advocate for the applicants<br \/>\nsubmitted that he was not having  papers, it was the duty of the<br \/>\nadvocate even to remain present even in first call on the next date<br \/>\nof hearing.\n<\/p>\n<p>7.\tEven<br \/>\nthe cause shown by the applicants in the application is self<br \/>\ncontradictory. On one hand  it has been submitted by learned advocate<br \/>\nfor the applicants that Shri Mangukiya, learned advocate was busy in<br \/>\nanother Court and therefore, he could not remain present at the time<br \/>\nwhen the matter was called out, however, on the other hand it is the<br \/>\ncase on behalf of the applicants that as Ms. Davawala, learned<br \/>\nadvocate for the respondent No. 6 had filed a sick note, Shri<br \/>\nMangukiya, learned advocate for the applicants was under the<br \/>\nimpression that the matter will be adjourned, therefore, he did not<br \/>\nremain present. Both the aforesaid are contradictory. Therefore the<br \/>\napplicants have not come with the clean hands and have not stated<br \/>\ncorrect facts and the  cause, which disentitled the discretionary<br \/>\nrelief.\n<\/p>\n<p>8.\tNow<br \/>\nso far as the reliance placed upon  the decision of the Hon&#8217;ble<br \/>\nSupreme Court in the case of                    Rafiq and<br \/>\nanother(supra) on considering<br \/>\nthe same, it appears that<br \/>\nthe same would not be of any assistance to the applicants in the<br \/>\nfacts and circumstances of the present case narrated hereinabove.<br \/>\nEvery decision is on facts of the case and there is no absolute<br \/>\nproposition of law laid down by the Hon&#8217;ble Supreme Court in the<br \/>\naforesaid case that in every case when there is a negligence on the<br \/>\npart of the advocate, application for restoration must be allowed.<br \/>\nEverything depends upon the earlier proceedings of the case and the<br \/>\nconduct. Under the circumstances, no case is made out to restore the<br \/>\nmain Appeal from Order, more particularly, when interim injunction<br \/>\ngranted by the learned City Civil Court, Ahmedabad below Notice of<br \/>\nMotion has been continued since February 2007 i.e. for more than<br \/>\nthree years.\n<\/p>\n<p>7.\tIn<br \/>\nview of the above and for the reasons stated above, present<br \/>\napplication  deserves to be dismissed and is accordingly dismissed.<br \/>\nHowever, considering the fact that the suit is of the year 2004 the<br \/>\nlearned City Civil Court, Ahmedabadd is directed to expedite the suit<br \/>\nsubject to cooperation by all concerned.
