It<br \/>\nis also stated in the said letter that the office of the Official<br \/>\nLiquidator have been informed to take necessary steps in this regard.\n<\/p>\n<p>(2)\tIn<br \/>\nthe light of the aforesaid note, the court had inquired from the<br \/>\nOfficial Liquidator as to whether he desires to be substituted in<br \/>\nplace of the petitioner-company and prosecute the proceedings<br \/>\nfurther, pursuant to which Ms.Ami Yajnik, learned Standing Counsel<br \/>\nappearing for the Official Liquidator, has submitted that in the<br \/>\nlight of the order dated 07.09.1989 passed by this Court, whereby the<br \/>\nrespondents had been granted liberty to proceed with the adjudication<br \/>\nin respect of the goods in question in accordance with law, the<br \/>\nofficial liquidator is not interested in pursuing the present<br \/>\npetition any further as against the order made by the adjudicating<br \/>\nauthority, the petitioner has a statutory remedy by way of appeal.\n<\/p>\n<p>(3)\tIn<br \/>\nthe light of the stand adopted by the Official Liquidator, the<br \/>\npetition is dismissed for non-prosecution, leaving it open to the<br \/>\npetitioner to avail the statutory remedy available under the Act, in<br \/>\ncase it so desires. RULE is discharged.
