HEMA, J.\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n                     B.A. No. 123 of 2009\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n           Dated this the 15th day of January,2009\n\n                            O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 294(b), 324,<\/p>\n<p>326 read with section 34 IPC.         According to   prosecution,<\/p>\n<p>petitioner and de facto complainant&#8217;s friend had some difference<\/p>\n<p>of opinion, following an altercation between them. On the date<\/p>\n<p>of occurrence petitioner and others came to de facto<\/p>\n<p>complainant and enquired about &#8220;Prince&#8221; under the impression<\/p>\n<p>that he was hidden by de facto complainant. When he explained<\/p>\n<p>about his ignorance, he was assaulted by petitioner and others<\/p>\n<p>using iron rod and de facto complainant sustained a fracture on<\/p>\n<p>his arm.\n<\/p>\n<p>       3. Learned counsel for          petitioner submitted that<\/p>\n<p>petitioner is absolutely innocent. According to        petitioner,<\/p>\n<p>petitioner is a witness in a case against one &#8216;Soman Pillai&#8217; who is<\/p>\n<p>a political leader. Therefore, petitioner is falsely implicated.<\/p>\n<p>Petitioner has not committed any offence and there is no motive<\/p>\n<p>for petitioner and there is no rivalry between petitioner and de<\/p>\n<p>facto complainant .\n<\/p>\n<p>       4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>BA 123\/09                          -2-\n<\/p>\n<p>submitted that     the nature of the allegations made against<\/p>\n<p>petitioner is serious. The facts stated by petitioner&#8217;s counsel are<\/p>\n<p>insufficient to grant anticipatory bail. Recovery of weapon for<\/p>\n<p>the offence is to be effected and hence, this is not a fit case to<\/p>\n<p>grant anticipatory bail.\n<\/p>\n<p>       5. On hearing both sides, I find that considering the<\/p>\n<p>nature of allegations made and the nature of investigation<\/p>\n<p>required, it is not a fit case to grant anticipatory bail. The<\/p>\n<p>incident occurred on 14-12-2008 and petitioner is not available<\/p>\n<p>for investigation and the investigation in a stand still.<\/p>\n<p>              Hence, petitioner is directed to         surrender<\/p>\n<p>       before the    Investigating Officer without any delay<\/p>\n<p>       and co-operate with the investigation.
