OF JHARKHAND\n                                      -----------\n<\/pre>\n<p>2.   16.11.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                  the State.\n<\/p>\n<p>                               The petitioner seeks the relief to be considered<\/p>\n<p>                  for compassionate appointment on account of the death<\/p>\n<p>                  of his father in harness on 16.4.1985 while he was<\/p>\n<p>                  posted at Palamu now in the State of Jharkhand<\/p>\n<p>                  consequent to the reorganization of the State of Bihar.<\/p>\n<p>                               It   is   submitted   that   the   mother   of   the<\/p>\n<p>                  petitioner applied for compassionate appointment in<\/p>\n<p>                  1986 on which no action was taken for a decision.<\/p>\n<p>                  Merely because the State of Bihar has been now<\/p>\n<p>                  bifurcated and death may have occurred in an area<\/p>\n<p>                  which falls in the newly created State of Jharkhand,<\/p>\n<p>                  shall not defeat the obligation of the State of Bihar to<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>consider the claim. It is apparent that the delay lies at<\/p>\n<p>the doors of the respondents who did not take any<\/p>\n<p>decision on the claim of the mother of the petitioner<\/p>\n<p>which shall be deemed to be pending and therefore the<\/p>\n<p>petitioner has a right to be considered in continuation of<\/p>\n<p>the same. Strong reliance is placed on a communication<\/p>\n<p>dated 22.8.2009 of the Chief Engineer, Water Resources<\/p>\n<p>Department, Aurangabad to support the assertion that<\/p>\n<p>he has opined that it merits consideration.<\/p>\n<p>           Counsel for the State emphasizes the delay to<\/p>\n<p>submit that the application merits no consideration.<\/p>\n<p>           From the communication dated 22.8.2009, it is<\/p>\n<p>apparent    that   the   application   for   compassionate<\/p>\n<p>appointment preferred by the mother of the petitioner<\/p>\n<p>was forwarded for consideration when it was returned on<\/p>\n<p>18.4.1987 with objections.       If that be the correct<\/p>\n<p>position, it was for the mother of the petitioner to pursue<\/p>\n<p>matters appropriately.     Any claim for compassionate<\/p>\n<p>appointment arising out of the death of the deceased<\/p>\n<p>came to an end on 18.4.1987. There cannot be different<\/p>\n<p>claims for compassionate appointment by different<\/p>\n<p>family members, at different points of time. There has to<\/p>\n<p>be only one claim for compassionate appointment on the<\/p>\n<p>death of the deceased in harness.\n<\/p>\n<p>           On the own showing of the petitioner he was<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>one year old on the date that his father died. He has<\/p>\n<p>applied for compassionate appointment on 1.10.2005<\/p>\n<p>nearly 20 years 6 months later. To this Court, the very<\/p>\n<p>fact that he has survived all these years, matured into<\/p>\n<p>an adult aware of his rights pursuing the litigation<\/p>\n<p>satisfies the Court that he was not a destitute in penury<\/p>\n<p>with a compulsive need for compassionate appointment.<\/p>\n<p>He had the wherewithal to survive for these long years.<\/p>\n<p>         In any event of the matter, he was a minor on<\/p>\n<p>the date of death ineligible to apply. The time period of<\/p>\n<p>two years within which the application was to be<\/p>\n<p>submitted computed from the date of death expired<\/p>\n<p>during his minority.   On account of his minority, the<\/p>\n<p>petitioner cannot claim a vested right to be considered<\/p>\n<p>for compassionate appointment based on family lineage<\/p>\n<p>and the consequent right to the post.\n<\/p>\n<p>         In A.I.R. 1998 SC 2612 AIR 1998 SUPREME<\/p>\n<p>COURT 2612 &#8220;<a href=\"\/doc\/1572559\/\">State of U.P. v. Paras Nath<\/a>&#8221; noticing a<\/p>\n<p>claim for compassionate appointment made 17 years<\/p>\n<p>after the death of the deceased, the Court has observed<\/p>\n<p>as follows at Paragraph-5<\/p>\n<p>                   &#8220;5. The purpose of providing<br \/>\n         employment     to    a   dependant      of   a<br \/>\n         Government servant dying in harness in<br \/>\n         preference to anybody else, is to mitigate the<br \/>\n         hardship caused to the family of the<br \/>\n         employee on account of his unexpected<br \/>\n         death while still in service. To alleviate the<br \/>\n         distress of the family, such appointments<br \/>\n         are permissible on compassionate grounds<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>                    provided there are Rules providing for such<br \/>\n                    appointment. The purpose is to provide<br \/>\n                    immediate financial assistance to the family<br \/>\n                    of a deceased Government servant. None of<br \/>\n                    these considrations can operate when the<br \/>\n                    application is made after a long period of<br \/>\n                    time such as seventeen years in the present<br \/>\n                    case.&#8221;\n<\/p>\n<p>                There is no merit in this application.       It is<\/p>\n<p>           accordingly dismissed.\n<\/p>\n<\/p>\n<pre>P.
