GOVERNMENT\nPLEADER for Respondent(s) : 5 -\n6, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 14\/08\/2008  \n \nORAL JUDGMENT<\/pre>\n<p>\tIn<br \/>\nthis petition, the petitioner has challenged the order dated<br \/>\n26.7.2002 passed by the specified authority \/ labour commissioner in<br \/>\npermission application No.7 of 2002 whereby, the said specified<br \/>\nauthority granted permission in favour of the respondent No.1 herein<br \/>\nfor closure of its unit viz. Abad Dairy (hereinafter referred to as<br \/>\n\u00fdSthe dairy\u00fd\u00fd). The petitioner union has also challenged award<br \/>\ndated 28.1.2005 passed by the Industrial Tribunal, Ahmedabad whereby,<br \/>\nthe Industrial Tribunal rejected the reference and confirmed the<br \/>\norder granting permission for closure of the dairy. The petitioner<br \/>\nhas also prayed that during the pendency of the petition, the<br \/>\nconcerned persons may be offered the benefit of VRS based on the pay<br \/>\nscales of 5th Pay Commission in the same manner as was<br \/>\noffered to other  employees.\n<\/p>\n<p>\tThe<br \/>\nfacts in the background of the controversy involved in present<br \/>\npetition are that, the dairy was, as per its claim, running into<br \/>\nheavy loss due to circumstances beyond its control and there were<br \/>\nhuge accumulated losses and as a cumulative result of the huge<br \/>\naccumulated loss and circumstances beyond its control, the dairy had<br \/>\nbecome economically inviable. Thus, upon being compelled by such<br \/>\ncircumstances, the respondent No.1 corporation made an application<br \/>\ndated 29.5.2002 under section 25(0)(1), praying for prior permission<br \/>\nto close down the dairy. The said application of the respondent<br \/>\ncorporation was numbered as permission application No. 7 of 2002.<br \/>\nAfter hearing the respondent No.1 corporation and the representative<br \/>\nof the union representing the workmen, the specified authority<br \/>\ngranted permission by its order dated 26.7.2002 for closure of said<br \/>\ndairy. The petitioner union was aggrieved by the said order granting<br \/>\npermission and that therefore, sought reference against the said<br \/>\norder dated 26.7.2002. The said dispute was referred and culminated<br \/>\ninto reference (IT) No.254 of 2002. After detailed hearing and upon<br \/>\nexamination of voluminous record, the Industrial Tribunal rejected<br \/>\nthe reference by its award dated 18.1.2005 and confirmed the order<br \/>\ndated 26.7.2002 passed by the specified authority. Consequently, the<br \/>\npermission granted by the specified authority by its order dated<br \/>\n26.7.2002 became final. Aggrieved by the said two orders, the<br \/>\npetitioner union is before this court.\n<\/p>\n<p>\tInitially,<br \/>\nthe petitioner union, in the subject petition, challenged only the<br \/>\naforesaid two orders and by way of alternative relief, also prayed<br \/>\nthat the order granting permission may be modified so as to<br \/>\nincorporate conditions like VRS or pay scale of 5th Pay<br \/>\nCommission, etc. and then during pendency of this petition, also<br \/>\nrequested for certain amendments in the petition. The request was<br \/>\ngranted. Since then various orders have been passed from time to time<br \/>\ngiving diverse directions to the contesting parties.\n<\/p>\n<p>\tEssentially<br \/>\nand in substance, present petition is against the said order dated<br \/>\n26.7.2002 granting permission for closure of Abad Dairy and the award<br \/>\ndated 28.1.2005 rejecting the reference and confirming the said order<br \/>\ndated 26.7.2002. It is not in dispute that the actual closure of the<br \/>\ndairy has become final. It has also came on record that at certain<br \/>\npoint of time the dairy was declared sick unit and the attempts for<br \/>\nits revival during pendency of the proceedings before the BIFR did<br \/>\nnot yield any result.\n<\/p>\n<p>\tIn<br \/>\nthis petition, which essentially and in substance challenges the<br \/>\naforesaid two orders dated 26.7.2002 and 28.1.2005, it would neither<br \/>\nbe possible nor practicable at this stage, for this court, to examine<br \/>\nthe alternative relief prayed for by the petitioner union namely, the<br \/>\nrelief for the benefit of VRS based on the pay scale of 5th<br \/>\nPay Commission. Even otherwise, the decision to grant or not to grant<br \/>\nsuch benefit to the employees who have at the relevant time not opted<br \/>\nfor VRS is a matter of policy. The petitioner union being, conscious<br \/>\nof the aforesaid difficult position with reference to its said<br \/>\nalternative prayer, today submitted through its learned counsel that<br \/>\nthe petitioner union, on behalf of its members i.e. concerned<br \/>\nworkmen, was willing to make representation to the concerned and<br \/>\ncompetent authority for favourable consideration of the request for<br \/>\ngrant of VRS with pay scale of 5th Pay Commission. On<br \/>\nbehalf of the petitioner union, it was submitted that the union has<br \/>\nchallenged the said two orders and in alternative, has also<br \/>\nchallenged the omission on the part of the employer to grant VRS<br \/>\nbased on pay scale of 5th Pay Commission.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>K.M.Patel, learned Senior Counsel appears with Mr. J.M.Patel for the<br \/>\nrespondent corporation. He submitted that it is a matter of<br \/>\npetitioner&#8217;s choice to make representation for the said relief and in<br \/>\npresent circumstances, it would be for the State Government to take<br \/>\ninto account the said request \/ representation and the respondent<br \/>\ncorporation, pursuant to the closure of the dairy does not have any<br \/>\nsubstantial say in the matter so far as such request is concerned,<br \/>\nmore particularly, since the concerned persons had not opted for or<br \/>\naccepted the said benefit of VRS at the relevant point of time. Be<br \/>\nthat as it may, the fact of the matter is that today on behalf of the<br \/>\npetitioner union it is submitted that though originally the<br \/>\npetitioner union challenged the aforesaid two orders, at the<br \/>\nbeginning of the final hearing, the union was very enthusiastic about<br \/>\nreopening the dairy, it is now desirous to make representation on<br \/>\nbehalf of and in the interest of the concerned employees to the<br \/>\nconcerned and competent respondent authority for grant of the benefit<br \/>\nof VRS based on the pay scales of 5th Pay Commission. Mr.<br \/>\nSahani, on behalf of the petitioner union, clarified that the<br \/>\npetitioner union is not claiming the benefit of pay scale of 5th<br \/>\nPay Commission for the period of service tenure but is requesting the<br \/>\nbenefit of the pay scale of 5th Pay Commission only for<br \/>\nthe purpose of VRS i.e. for calculating the amount payable towards<br \/>\nVRS. It is submitted on behalf of the petitioner union that for the<br \/>\naforesaid purpose, the petitioner desires to withdraw this petition<br \/>\nwith a view to making representation to the concerned and competent<br \/>\nauthority who is expected to consider the same sympathetically. Mr.<br \/>\nPatel, Senior Advocate with Mr. J.M.Patel submitted that the<br \/>\nrespondent corporation cannot have, and does not have, any objection<br \/>\nif the petitioner union seeks to withdraw the petition for making<br \/>\nrepresentation to the concerned and competent authority. He, however,<br \/>\nclarified that it would not be within the authority of the<br \/>\ncorporation to take any such decision and the said aspect would<br \/>\nsquarely fall within the authority of the State Government.<br \/>\nObviously, the petitioner would keep the aforesaid aspect in focus<br \/>\nwhile making proposed request \/ representation.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid request of the petitioner union, through its<br \/>\nlearned advocate Mr. Sahani for permission to withdraw the petition<br \/>\nwith a request for making representation for the aforesaid benefit to<br \/>\nthe concerned and competent authority and in view of the fact that<br \/>\nthe respondents have no objection if the petition is permitted to be<br \/>\nwithdrawn for the aforesaid purpose, the permission as requested for<br \/>\nby the petitioner union is granted. The petition stands disposed of<br \/>\nas withdrawn. It would be open for the petitioner union to make<br \/>\nrepresentation to grant benefit of VRS based on the pay scales of 5th<br \/>\nPay Commission. Mr. Sahani submitted that the petitioner union would<br \/>\nmake such representation within a period of 4 weeks from 25th<br \/>\nAugust, 2008 i.e.  on or before 26th September, 2008. It<br \/>\nis hoped that if and when such representation is made, the concerned<br \/>\nand competent authority will consider the same and take appropriate<br \/>\ndecision preferably within 3 months from the date of receipt of<br \/>\nrepresentation. Mr. Sahani also clarified that the petitioner would<br \/>\nconfine the proposed representation only to claim the aforesaid<br \/>\nbenefit.\n<\/p>\n<p>\tSince<br \/>\nthe petitioner has requested for permission to withdraw the petition,<br \/>\npresent petition is, with the aforesaid observations and<br \/>\nclarification, disposed of, without going into the merits, as<br \/>\nwithdrawn. Rule discharged. Ad-interim relief, if any, stands vacated<br \/>\nforthwith.
