It is<br \/>\n\tsubmitted that the bare reading of the FIR would suggest that so far<br \/>\n\tas the present petitioner is concerned, he was not the owner of the<br \/>\n\tdisputed land, but in the sale-deed, he was mere confirming party.<br \/>\n\tIt is further submitted that in connection with the said land, civil<br \/>\n\tsuit was filed in Civil Court of Bhavnagar and in the FIR it is<br \/>\n\talleged that since the Court Commissioner was to come for local<br \/>\n\tinspection and, therefore, some damage came to be made in the<br \/>\n\tproperty, but in fact the date on which the alleged incident<br \/>\n\toccurred i.e. on 8.8.2010, till then the petitioner was not at all<br \/>\n\tserved with any summons or any notice of said civil suit and,<br \/>\n\ttherefore, he was not knowing about pendency of any suit or that the<br \/>\n\tCourt Commissioner was to come for local inspection. It is further<br \/>\n\tsubmitted that considering the FIR, the alleged incident occurred at<br \/>\n\tabout 2.30 a.m. to 3 a.m. On 8.8.2010, and as emerged from the FIR,<br \/>\n\tsoon after the incident, police came at the place and police<br \/>\n\tescorted the first informant Indrajitsinh<br \/>\n\tDilubha Gohil to Vartej police station despite that the FIR came to<br \/>\n\tbe filed at 1.30 p.m., and thus the FIR was belated. The bare<br \/>\n\treading of the FIR would suggest that first informant was not beaten<br \/>\n\tby this petitioner, but on the contrary the FIR suggests that he was<br \/>\n\treleased from the confinement<br \/>\n\tby the present petitioner. My attention was drawn to the true copies<br \/>\n\tof the orders passed by this Court granting anticipatory bail to two<br \/>\n\tco-accused persons. Therefore, it is requested that the application<br \/>\n\tmay be granted.\n<\/p>\n<p>\tPer<br \/>\n\tcontra, Mr.K.L.Pandya, learned APP representing the respondent &#8211;<br \/>\n\tState of Gujarat vehemently opposed this application and submitted<br \/>\n\tthat considering the FIR, it is clear that the present petitioner is<br \/>\n\tmain accused person. It is further submitted that the custodial<br \/>\n\tinterrogation of the petitioner is highly required. The petitioner<br \/>\n\tis interested in the disputed land and that fact emerges from the<br \/>\n\tsale-deed wherein he is referred as confirming party to the sale<br \/>\n\ttransaction. The co-accused persons, who were granted anticipatory<br \/>\n\tbail by this Court were attributed minimal role by the complainant<br \/>\n\tin the FIR. That, therefore, the present petitioner cannot claim any<br \/>\n\tparity that the benefit given to the co-accused should be enured to<br \/>\n\thim. Ultimately, it is submitted that the application may be<br \/>\n\tdismissed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the facts and circumstance of the case, so also the<br \/>\n\tsubmissions advanced on behalf of both the sides and considering the<br \/>\n\tfact that in connection with the disputed land though civil suit was<br \/>\n\tfiled, but as recorded in earlier orders passed by this Court and as<br \/>\n\tsubmitted on behalf of the<br \/>\n\tpetitioner, on the date of the incident, no summons or notice came<br \/>\n\tto be served to the petitioner and further considering the fact that<br \/>\n\tso far beating aspect is concerned, no direct allegation is levelled<br \/>\n\tagainst the petitioner that the complainant was beaten by him, but<br \/>\n\ton the contrary, in the FIR itself it is stated that the complainant<br \/>\n\twas released from the confinement by the petitioner and, further the<br \/>\n\tfact that by imposing necessary condition, the apprehension<br \/>\n\tventilated on behalf of the State that if anticipatory bail would be<br \/>\n\tgranted, it would adversely affect the custodial interrogation by<br \/>\n\tthe police, can be conveniently taken care of, this Court is of the<br \/>\n\topinion that the petitioner is entitled to anticipatory bail as<br \/>\n\tprovided u\/s.438 of the Code.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The petitioner is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tBhavnagar &#8216;D&#8217; division police station<br \/>\n\tC.R.No. I &#8211; 121\/2010 in respect of the offences alleged<br \/>\n\tagainst him on his executing bond of Rs.5,000\/- (Rupees Five<br \/>\n\tthousand only) with one solvent surety of the like amount, by him,<br \/>\n\tby the concerned Police Officer and on conditions that he shall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as and when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 25.10.2010 between 11.00 a.m. and 4.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer between 11:00 a.m. to 05:00 p.m. &#8211; before sunset;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, and shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the petitioner is arrested at any time<br \/>\n\twithin 90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of her arrest,<br \/>\n\tduring which it will be open to the petitioner to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time, uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis  made absolute to the aforesaid extent.
