The complainant party has been convicted.<br \/>\nThe Investigating Officer of the case, in his deposition, has  stated<br \/>\nthat he is not in a position to ascertain as to which party  was<br \/>\naggressor.  In that view, it is  very difficult at  this  stage to<br \/>\nascertain as to which party was  aggressor. The prosecution was<br \/>\nitself  at a loss to judge that which party was aggressor.\n<\/p>\n<p>\tWith<br \/>\nregard to the bail application of Pathubha Govindji Rathod, applicant<br \/>\nNo.1 in Criminal Misc. Application No.13042 of 2008,  is concerned,<br \/>\nhe was an accused , who was  armed  with lethal revolver and he fired<br \/>\n six  shots.  If  this  was a case in his  defence,  then it cannot<br \/>\nbe said that  he could fire  six  shots in right of private  defence.<br \/>\nIn that view of the  matter, the bail  application of this Pathubha<br \/>\nGovindji Rathod is rejected.\n<\/p>\n<p>\tWith<br \/>\nregard to bail application of Hemubha Govindji Rathod, applicant No.2<br \/>\nin Criminal Misc. Application No.13042 of 2008,  is concerned, who is<br \/>\n said to be an assailant  of  Hamirbhai Nagabhai-  another  deceased<br \/>\nbecause  Nathabhai Nagabhai has been killed  by bullet injury. This<br \/>\ndeceased, in his first  version  given to the  doctor in the<br \/>\nhospital,  stated that  he has been assaulted by Punjajibhai and his<br \/>\nsons.  If  this  deceased&#8217;s version is taken into consideration then<br \/>\nhis  assailants were  Punjajibhai and his  sons.  Attribution to<br \/>\nHemubha is that he caused  injury  by sword. Then  the question<br \/>\nrequires to be debated in light of the statements of  other<br \/>\nwitnesses.\n<\/p>\n<p>\tApart<br \/>\n from these two persons, the other persons  cannot be attributed with<br \/>\nany injury to the deceased which were  effective. The other persons<br \/>\nhave been assigned minor  injury here and there. Therefore, they are<br \/>\nalso ordered to be released on bail  along with  those  who were on<br \/>\nbail during trial.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe bail application of  Pethubha Govindji Rathod,  applicant No.1 in<br \/>\nCriminal Misc. Application No.13042 of 2008, is rejected and the bail<br \/>\napplication of the other co-accused persons, i.e applicant Nos. 2 to<br \/>\n7, and the bail application of the applicants, being Criminal Misc.<br \/>\nApplication No.13047 of 2008, are allowed in the facts and<br \/>\ncircumstances of the case and they are enlarged on bail on their<br \/>\nfurnishing a solvent surety of Rs.5,000\/- each and personal bond(s)<br \/>\nof the like amount on usual terms and on the following further<br \/>\nconditions:-\n<\/p>\n<p>(1)\tThe<br \/>\napplicants shall not leave the territory of State of Gujarat without<br \/>\npermission of this Court.\n<\/p>\n<p>(2)\tThe<br \/>\napplicants shall not involve themselves in such or similar offence<br \/>\nhereafter.\n<\/p>\n<p>\tIn<br \/>\nthe meanwhile, the substantive  sentence  shall remain under<br \/>\nsuspension. Bail bond before the Trial Court.
