No.240 OF 2009\n          ========================\n        Dated this the 12nd day of March 2010.\n\n                         JUDGMENT\n<\/pre>\n<p>     This is an appeal preferred against the Workmen&#8217;s<\/p>\n<p>Commissioner, Thrissur in W.C.C. No. 53\/2004. The claimant<\/p>\n<p>therein sustained injuries in a road accident and has been<\/p>\n<p>awarded compensation of Rs.51,122\/- with 12% interest<\/p>\n<p>from the date of application. It is against that decision the<\/p>\n<p>Insurance Company has come up in appeal.\n<\/p>\n<p>    1. Challenging the employer-employee<\/p>\n<p>        relationship.\n<\/p>\n<p>    2. Challenging the percentage of disability and<\/p>\n<p>        loss of earning capacity.\n<\/p>\n<p>    3. Regarding the interest.\n<\/p>\n<p>     2. So far as the 1st point is concerned at least there<\/p>\n<p>is  evidence to show that he was working on that day<\/p>\n<p>when the accident occurred under the owner and no other<\/p>\n<p><span class=\"hidden_text\">M.F.A. No.240 OF 2009            2<\/span><\/p>\n<p>evidence is available to prove that      his employment was<\/p>\n<p>such a        casual nature.   Therefore, I do not propose to<\/p>\n<p>interfere with the decision       rendered on the employer-<\/p>\n<p>employee relationship.\n<\/p>\n<p>       3. Next question is regarding the       percentage of<\/p>\n<p>disability and loss of earning capacity. Time and again I<\/p>\n<p>have come             across the orders of this Workmen&#8217;s<\/p>\n<p>Compensation Commissioner where without any application<\/p>\n<p>of mind       when an application for reference to the medical<\/p>\n<p>board is made it is summarily dismissed. I am making this<\/p>\n<p>reference for the following reasons:-\n<\/p>\n<p>       4. The injuries      noted in the order are     multiple<\/p>\n<p>lacerated wound over the right side of the scalp, lacerated<\/p>\n<p>wound in right forearm and abrasion over right scapula.<\/p>\n<p>Under ordinary circumstance these injuries are incapable<\/p>\n<p>of     creating disability unless there are      certain other<\/p>\n<p>complications         developed on account of the injuries<\/p>\n<p>sustained.         The   learned counsel for the respondent<\/p>\n<p>produced before me a copy of the disability certificate where<\/p>\n<p><span class=\"hidden_text\">M.F.A. No.240 OF 2009             3<\/span><\/p>\n<p>I find that the person had oedema.         A doctor, at Thrissur<\/p>\n<p>who has no occasion to treat him shows the disability after<\/p>\n<p>a period of 5 years and that certificate does not show what<\/p>\n<p>are the        clinical examination or radiological examination<\/p>\n<p>conducted by him to find out the disabilities mentioned in<\/p>\n<p>his certificate.        It was under those circumstances that<\/p>\n<p>Insurance Company moved an application for examination<\/p>\n<p>by medical board which was out rightly rejected by the<\/p>\n<p>Workmen&#8217;s Compensation Commissioner. However it has<\/p>\n<p>to be held that the Workmen&#8217;s Compensation Commissioner<\/p>\n<p>had not followed dictum laid down by this court reported<\/p>\n<p>in <a href=\"\/doc\/1848699\/\">Vanajakshan V. Joseph,<\/a> (2003 (2) KLT 462 (FB))<\/p>\n<p>where the Full Bench held that while assessing disability<\/p>\n<p>it is the paramount duty to find out the incapacity to do<\/p>\n<p>all the work which one was capable of doing and not with<\/p>\n<p>respect to a particular work which he was doing.            The<\/p>\n<p>Workmen&#8217;s          Compensation   Commissioner     have     not<\/p>\n<p>followed the said dictum          as well.  Therefore,   this is<\/p>\n<p>eminently a fit case where the order has to be set aside,<\/p>\n<p><span class=\"hidden_text\">M.F.A. No.240 OF 2009            4<\/span><\/p>\n<p>and direct the Workmen&#8217;s Compensation Commissioner to<\/p>\n<p>refer the claim to a medical board for proper examination<\/p>\n<p>to find out the disability as well as the loss of        earning<\/p>\n<p>capacity if any as stipulated in the Full Bench Decision of<\/p>\n<p>this Court referred to above. Since the matter is going back,<\/p>\n<p>so     far    as     interest is  concerned,    the  Workmen&#8217;s<\/p>\n<p>Compensation Commissioner may decide it in accordance<\/p>\n<p>with law. I must also mention that this Court had taken the<\/p>\n<p>view that in the light of <a href=\"\/doc\/636231\/\">National Insurance Company<\/p>\n<p>Ltd V. Rekha,<\/a>(2007(4) KLT 386) and also in the light of<\/p>\n<p>decision of Supreme Court in <a href=\"\/doc\/1640530\/\">Pratap Narain Singh Deo V.<\/p>\n<p>Shrinivas Sabata (AIR<\/a> 1976 SC 222) a decision of the<\/p>\n<p>Constitution Bench interest has to be given from the date<\/p>\n<p>of the accident. But        here the interest is only given from<\/p>\n<p>the date of filing of the petition and that is a matter which<\/p>\n<p>the Court can decide in accordance with the position of law<\/p>\n<p>on that relevant date.          The Workmen&#8217;s Compensation<\/p>\n<p>Commissioner is directed to issue notice to the parties for<\/p>\n<p>fixing the date of appearance and then proceed to dispose<\/p>\n<p><span class=\"hidden_text\">M.F.A. No.240 OF 2009         5<\/span><\/p>\n<p>of the matter in accordance with law.
