This writ petition coming on for Preliminary Hearing this<\/p>\n
 day, the Court made the following:\n<\/p>\n
QRDER<\/p>\n
The petitioner has raised the challenge <\/p>\n
respondent’s order, dated 1.1.2008 (Annexure–A)  <\/p>\n
the petitioner for a period of 6 years inffexercise offti4.ie_ :p’oAweVr:<\/p>\n
conferred by Section 308–C of the l_(arnaAta__k>a\u00e9anchairat <\/p>\n
1993 (‘the said Act’ for short).\n<\/p>\n
2. Sri Jayakumar Sf. Senior Counsel
\nappearing for Sri Manmohami.-‘\u00a7?’;l;l.;ffoVr– the submits that
\nthe petitioner was.    to Chickamagalur
\nZilia  in 2005. The
\npetitioner  as a }D(S) candidate. The
\nsaid political   petitioner that the party itself
\nwould file\ufb01gthe. expendiltureiireturns with the Returning Officer.<\/p>\n
rigereartefr, t_he_petit,ioner left 3o(s) and joined BJP. The learned<\/p>\n
 Senior.Counlsel”_\u00a7wo~u’i’d. therefore submit that 39(5) appears to<\/p>\n
Vir__ha~;e |ost.””‘inte:rest””lin filing the election returns of the petitioner,<\/p>\n
.1  ‘i*.es,_.chvanged the party. He also submits that the notice,<\/p>\n
if.”v’..:da.ted'”\u00a3i;5}2006, to which a reference is made in the impugned<\/p>\n
 ‘  oi’–dVe’r”is not served on the petitioner at all. He submits that the<\/p>\n
 notice, which is produced as Annexure-R2 with the State<\/p>\n

Election Commission’s statement of objections, does not bear<\/p>\n
the acknowledgement of the petitioner.\n<\/p>\n

\ndate of declaration of the \u00e9lpetitioyner has
\nfailed to discharge the obligatiVo:nsA,_ca'stxiJ|3<s,,j':.ii.'i:ijti._',by the statute.
\nEven on the failure' .. the expenditure
\nreturns, the mechanically passed
\nthe order of  A E<\/p>\n
4. Sri Pihanindra’  to give the fairest of fair
\noVppo_rtuni.ti5esV:to theV”petit_i_oAn:er, the Election Commission issued<\/p>\n
the*._notice., d.avted’i.,\u00a7”;~5_,2006. As the said notice has not evoked<\/p>\n
:–“a_the fi’.li’n,g’—.iofvv.’the account of election expenses, the Election<\/p>\n
w’7,.Cor.nmissihon_has  htly passed the impugned order.<\/p>\n
A   .._Ej\u00a7:ii’squalification order visits the person with serious civil<\/p>\n
 pofitical constituencies; it attaches stigma to the person. It<\/p>\n
it’—-.\\,AVis’*itherefore necessary that full opportunity has to be given to a<\/p>\n
QBH.\n<\/p>\n
party before passing any order in the matter. Giving fuii<\/p>\n
opportunity aione would be in keeping with the iegisi_at_ive<\/p>\n
intentmerit and provisions contained in Section 3G8–C_.di.’thie’js:ajid:____” _<\/p>\n
Act. Section 308C of the said Act reads as,foii_ows_;’-3″cf\u00bb. g  .<\/p>\n

\nrequired   ‘under this Act} –and___f’\n<\/p>\n
(b) has’::-no:ggoodirelasoh”orvjusti\ufb01cation for the

\nthe State “Electionf<liCe.n7mission shall by order
\npublished in'\u00ab the VCiffiCiai'~~~C:'azette declare him to be<\/p>\n
 \ufb02vdisqutzlified xand"a;-'3y_____sL.'ch person shall be disquali\ufb01ed<\/p>\n
V"  for.aipe_riod.of–.six years from the date of the order.<\/p>\n
the.ins,tant case, the petitioner's defence is that it<\/p>\n
"–l\u00abi.?v\u00a7Is__'a-greed iigon by the JD(S) that it wouid file the expenditure<\/p>\n
 account of the petitioner changing the party, the<\/p>\n
 not fiied the expenditure retiirns. Whether it 'is a<\/p>\n
Vliicllgipiauwsibie explanation or not, is for the Commission to decide.<\/p>\n
HEM.\n<\/p>\n

\nBut this explanation is required to be considered by the<\/p>\n
Commission.\n<\/p>\n
7. This Court compared the petitioner’s signature foiiiV_ndio_n<\/p>\n
the vakalath with the signature found on the <\/p>\n
9.5.2006 (Annexure~R2). The two signatures do\u00ab’ho’t~t’alIy’.t Thispi\u00e9  C<\/p>\n
is another circumstance to doubt as to”~,whjethter’itthe _”petiti’o.n”e1r_:<\/p>\n
has received the notice issued by the\ufb01lyyection Comrin:i’ss.i._0\u00abne,MV\n<\/p>\n
8. For the aforesaid. preasonslf”the-.._irnp’u’gn.edborder is
\nquashed. The Election Comn’i’i’slsion”tisfidirectediwitoreconsider the<\/p>\n
matter affording theVo.ppo_rtu\u00a71’ity’hearing  petitioner and<\/p>\n
thereafter take a ~deci”si’on”iinithe—-matter in accordance with law.
\nThe petitioner\u00e9is divrecteady present before the Election
\nCo_mmissiyo_h’ “at. 11.3’O.._a.Vm. :on 14.12.2010 without waiting for<\/p>\n
any nntic.e_ f rom the’~..Commissi on.\n<\/p>\n
9} pFurther}j’tftr.hat cannot be ignored is that the petitioner is<\/p>\n
.\ufb02jput’ting the ..a’v{>idab|e strain on the machinery of the Election<\/p>\n
 by not filing the expenditure returns within one<\/p>\n
“hfgm_on”thV’g;frorn the date of the declaration of the results in<\/p>\n
December 2005. He is therefore liable to pay a cost of ? 7,500\/-<\/p>\n
 .to the State Election Commission on or before 14″‘ instant.<\/p>\n
