Secretary, Freedom Fighters Division,<br \/>\nMinistry of Home Affairs, seeking the following information:\n<\/p>\n<blockquote><p>         &#8220;1.   The High Court of Gujarat had ordered on 29.10.2004 to<br \/>\n               release the arrears with 9 % interest. What actions taken\/<br \/>\n               noting made in our above case by various authorities\/<br \/>\n               officers after above order.\n<\/p><\/blockquote>\n<blockquote><p>         2.    After passing an order by Supreme Court of India on<br \/>\n               31.3.2006, my father called your office several times and<br \/>\n               wrote numerous letters and faxes as referred in Ref. (I) and<br \/>\n               (II). Why the arrear was not released before demise of my<br \/>\n               father on dated 24.7.2006? Which officers\/ authorities are<br \/>\n               responsible for this kind of irresponsible treatment to a<br \/>\n               freedom fighter?\n<\/p><\/blockquote>\n<blockquote><p>         3.    What is written by my father at para no 2 &amp; 3 of (A4) is as<br \/>\n               good as dying declaration before his death. We could not<br \/>\n               offer better treatment to my father as well as could not fulfill<br \/>\n               his last wishes due to financial hardship along with his<br \/>\n               nature of self respect being a freedom fighter. We wish to<br \/>\n               initiate legal action in the matter. Please furnish us the<br \/>\n               names and addresses of the concerned officers involved in<br \/>\n               the delay of above matter.\n<\/p><\/blockquote>\n<blockquote><p>         4.    What departmental actions have been taken against such<br \/>\n               irresponsible officers for such abnormal delay? If no action<br \/>\n               has been taken who is responsible authority not to take<br \/>\n               action against such irresponsible officers?\n<\/p><\/blockquote>\n<blockquote><p>         5.    You have issued intentionally erroneous order on 7.11.2006<br \/>\n               after filling of our appeal for the contempt of the High Court<br \/>\n               of Gujarat. It is necessary for every citizen of India to<br \/>\n               approach for contempt of the court to get his due from GOI?\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                               1<\/span><\/p>\n<blockquote><p>               It is the permanent policy of GOI to approach higher courts<br \/>\n              without looking to the merits of the case? If not, then why it<br \/>\n              is adopted in our case? Which authorities\/ officers made<br \/>\n              what noting in the matter to drag the case up to Supreme<br \/>\n              Court of India?\n<\/p><\/blockquote>\n<blockquote><p>       6.     The High Court of Gujarat passed an order dated<br \/>\n              29.10.2004 to pay arrears from the date of application, which<br \/>\n              in our case is 11.2.1991. Please let us know how you have<br \/>\n              decided date of application as 27.9.2005 as mentioned in<br \/>\n              your order and which authorities\/ officers made what noting<br \/>\n              to come to this conclusion?\n<\/p><\/blockquote>\n<blockquote><p>       7.     The High Court of Gujarat passed an order dated 3.10.2006<br \/>\n              in our civil application for amendment no 10157 of 2006 to<br \/>\n              replace my father name with my mother name in the present<br \/>\n              case. Please let us know how you have decided to pass an<br \/>\n              order in my father&#8217;s name on dated 7.11.2006 and which<br \/>\n              authorities\/ officers made what noting to come to this<br \/>\n              conclusion?&#8221;<\/p><\/blockquote>\n<p>    To this he received a reply from Shri V. K. Gupta, Dy. Secretary on 29.5.07<br \/>\nas follows:\n<\/p>\n<blockquote><p>       &#8220;1-4   There has been delay in implementation of order dated<br \/>\n              31.3.2006 of the Hon&#8217;ble Supreme Court, which has<br \/>\n              occurred neither willfully nor due to negligence but due to the<br \/>\n              time consuming but unavoidable administrative procedures<br \/>\n              which have to be gone through in cases like the present,<br \/>\n              where the decision has to be taken collectively. It may not<br \/>\n              be out of place to mention here that three separate SLPs<br \/>\n              were filed by the Union of India against the judgment dated<br \/>\n              14.6.20005 of the Hon&#8217;ble High Court of Gujarat, since all<br \/>\n              the three cases were clubbed together. The case could be<br \/>\n              processed only on 10.7.2006 after receipt of judgment of the<br \/>\n              Hon&#8217;ble Supreme Court in SLP No. 8735\/2006 decided on<br \/>\n              8.5.2006 for seeking approval of the competent authority for<br \/>\n              sanctioning pension. Approval of the Hon&#8217;ble Minister of<br \/>\n              State for Home was received in the FFR Division on<br \/>\n              14.9.2006. Immediately, thereafter identification documents<br \/>\n              were called from concerned freedom fighters vide letters<br \/>\n              dated 26.9.2006.\n<\/p><\/blockquote>\n<blockquote><p>       5.     As regards the sanction issued on 7.11.2006 granting<br \/>\n              pension to late Shri Babubhai Mohanlal Patel, you are<br \/>\n              informed that the officers\/ staff dealing with the matter were<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><br \/>\n                not aware at the material time regarding the Order dated<br \/>\n               3.10.2006 passed by the Hon&#8217;ble High Court of Gujarat.<br \/>\n               Pleas be informed that no officer would like to invite the<br \/>\n               wrath of the Hon&#8217;ble High Court, by willfully disobeying the<br \/>\n               orders of the Hon&#8217;ble High Court. You are further informed<br \/>\n               that issuance of wrong orders, unnecessarily increases the<br \/>\n               workload of staff and officers, who are already overworked<br \/>\n               and none of the officer\/ staff is willing to indulge in such<br \/>\n               tactics.\n<\/p><\/blockquote>\n<blockquote><p>       6.       In this regard it may be stated that the application dated<br \/>\n               11.2.1991 of your late father Shri Babubhai was not received<br \/>\n               in this Ministry. This position was clarified in the Counter<br \/>\n               Affidavit filed in the case. Copy of his application was<br \/>\n               received on 27.9.2005 through the State Government.&#8221;<\/p><\/blockquote>\n<p>     Shri V. K. Gupta has gone on to advise that Shri Patel&#8217;s mother submit an<br \/>\napplication for dependent&#8217;s family pension in the format thereof prescubed.\n<\/p>\n<p>     Aggrieved by this response appellant Shri Patel has then moved an appeal<br \/>\nto the First Appellate Authority, whose name and designation had not been<br \/>\nmentioned in response to his application, c\/o CPIO Shri V. K. Gupta, specifically<br \/>\non the ground that the response from CPIO had been unduly delayed and that,<br \/>\n&#8220;None of the reply is point wise as sought by me through 7 points of my<br \/>\napplication.   Please provide me specific and detailed information against my<br \/>\neach point.&#8221;\n<\/p>\n<p>     In response, however, he received a letter from Shri Manmohan, Under<br \/>\nSecretary, Ministry of Home Affairs dated 16.7.07 rejecting his appeal on the<br \/>\nfollowing grounds :\n<\/p>\n<blockquote><p>       &#8220;2.     It has been observed that the appellant, in the guise of<br \/>\n               seeking information under the RTI Act, has raised questions<br \/>\n               regarding the nature and quality of action taken by the CPIO,<br \/>\n               the procedure followed by the Ministry and about fixing of<br \/>\n               responsibility for delay in handling cases by concerned<br \/>\n               officers. It may be pointed out that the responsibility of the<br \/>\n               Appellate Authority is to see that if the appellant has not<br \/>\n               been given available information by the CPIO, the same is<br \/>\n               given to him. The Appellate Authority is not supposed to<\/p>\n<p><span class=\"hidden_text\">                                         3<\/span><br \/>\n              give replies to the questions raised by the appellant which,<br \/>\n             according to the RTI Act, are not covered by the definition of<br \/>\n             information. It has further been found that the CPIO has<br \/>\n             vide MHA&#8217;s letter No. 115\/979\/04-FF (WZ) dated 29.5.2007<br \/>\n             has given available information to the appellant and no<br \/>\n             information appears to have been suppressed by him.\n<\/p><\/blockquote>\n<blockquote><p>      3.     Attention of the appellant is drawn in this connection to<br \/>\n             Central Information Commission&#8217;s Order dated 21.4.2006, in<br \/>\n             which the Commission, had inter alia, observed as follows:\n<\/p><\/blockquote>\n<blockquote><p>      It is not open to an appellant to ask in the guise of seeking<br \/>\n      information, questions to the public authorities about the nature and<br \/>\n      quality of their actions. The RTI Act does not cast on the public<br \/>\n      authority any obligation to answer queries, as in this case, in which<br \/>\n      a petitioner attempts to elicit answers to his questions with prefixes,<br \/>\n      such as, why, what, when and whether. The petitioner&#8217;s right<br \/>\n      extends only to seeking information as defined in section 2 (f) either<br \/>\n      by pinpointing the file, document, paper or record, etc., or by<br \/>\n      mentioning the type of information as may be available with the<br \/>\n      specified public authority&#8230;&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      4.     In view of the above, it has not been found possible to<br \/>\n             accept the appeal submitted by the appellant and the same<br \/>\n             is rejected.\n<\/p><\/blockquote>\n<p>Appellant&#8217;s prayer before us in his second appeal is as below:\n<\/p>\n<blockquote><p>      &#8220;We feel that not only CPIO has provided misleading<br \/>\n      information but also suppressed the information. Hence reply<br \/>\n      of FAA is correct for this point.\n<\/p><\/blockquote>\n<blockquote><p>      We request you to bring the true and logical end of the<br \/>\n      matter.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 14.1.2009. The following are present:\n<\/p>\n<blockquote><p>      Appellant<br \/>\n            Shri Ramesh Babubhai Patel<br \/>\n      Respondents<br \/>\n            Shri Paul Ekka, Dy. Secretary<br \/>\n            Shri Harish Rajpal, Section Officer<\/p>\n<p>     On being asked how an Under Secretary, an officer junior to the Dy.\n<\/p><\/blockquote>\n<p>Secretary who in this case was the CPIO, has disposed of an appeal under the<\/p>\n<p><span class=\"hidden_text\">                                        4<\/span><br \/>\n RTI Act, Shri Paul Ekka Dy. Secretary has submitted that this was done with the<br \/>\napproval of Jt. Secretary, as mentioned in the response of the Under Secretary<br \/>\nShri Manmohan dated 16.7.07. While it was clarified that the application had<br \/>\nbeen received in the Division only on 10.4.07, this still does not explain a delay of<br \/>\nfurther 19 days before a reply was sent. However, we were told that the then<br \/>\nCPIO Shri V. K. Gupta, Dy. Secretary Gupta has since retired.\n<\/p>\n<p>     Appellant Shri Patel was asked what further information he requires to<br \/>\nwhich he responded that as laid down in his first appeal he requires an answer<br \/>\npointwise.\n<\/p>\n<p>                            DECISION NOTICE<\/p>\n<p>Sec. 7(9) of the RTI Act reads as follows :\n<\/p>\n<blockquote><p>       &#8220;An information shall ordinarily be provided in the form in which it is sought<br \/>\n       unless it would disproportionately divert the resources of the public<br \/>\n       authority or would be detrimental to the safety or preservation of the<br \/>\n       record in question.&#8221;<\/p><\/blockquote>\n<p>     In other words, response to an application is to be given in the form it is<br \/>\nasked, digressed upon only on grounds as specified. This is not the process that<br \/>\nhas been followed in the present case. Besides the law is clear in that an appeal<br \/>\ncan only be preferred &#8220;to such officer who is senior in rank to the CPIO or SPIO,<br \/>\nas the case may be, in each public authority&#8221; (Sec. 19 sub sec. (1)). Moreover it<br \/>\nis not up to the Appellate Authority to seek the assistance of any other officer for<br \/>\ndisposing of an appeal. Under Sec. 5(4) of the Act, this is permissible only to a<br \/>\nPIO. It is open to an Appellate Authority to transfer the matter to another<br \/>\nAppellate Authority if the matter does not pertain to him\/her but he cannot allow,<br \/>\neven with his approval, a junior official to rule upon an appeal against the<br \/>\ndecision of an officer senior to him.\n<\/p>\n<p>     The order of 16.7.07 of Under Secretary Shri Manmohan of Ministry of<br \/>\nHome Affairs is, therefore, set aside. First Appellate Authority Shri A. K. Goyal,<\/p>\n<p><span class=\"hidden_text\">                                         5<\/span><br \/>\n Jt. Secretary (FFR), MHA will now re-examine this matter and provide a<br \/>\npointwise response to appellant Shri Patel within ten working days of the<br \/>\ndate of receipt of this decision notice under intimation to Shri Pankaj KP<br \/>\nShreyaskar, Joint Registrar in this Commission. The appeal is, therefore,<br \/>\nallowed.\n<\/p>\n<p>      Announced in the hearing.
