Please supply a certified list thereof.\n<\/p><\/blockquote>\n<blockquote><p>       (b)       Why the necessary action under existing law, to remove such Dairies from<br \/>\n                 the jurisdiction\/purview of the Jabalpur Cantt could not be taken?\n<\/p><\/blockquote>\n<blockquote><p>       (c)       What action has so far been taken by the Cantonment Board for removal<br \/>\n                 of such Dairies ?\n<\/p><\/blockquote>\n<blockquote><p>       (d)       What action is now being taken for removal of such Dairies ?&#8221;\n<\/p><\/blockquote>\n<p>2.     In addition, he had also sought information on the following 02 paras :-\n<\/p>\n<blockquote><p>       &#8220;(a)      Why the Cantonment Board, Jabalpur has failed to prohibit the above LPG<br \/>\n                 Agency against un-authorised use of the Military Land ?\n<\/p><\/blockquote>\n<blockquote><p>       (b)       What action is now being taken to prohibit the above LPG Agency against<br \/>\n                 unauthorized use of the Military Land ?&#8221;\n<\/p><\/blockquote>\n<p>3.     Vide letter dated 28.5.2009, the CPIO had asked the appellant to deposit fee of<br \/>\nRs. 2\/- for supply of information. As the appellant has not received the requested<br \/>\ninformation, he has filed the present appeal.\n<\/p>\n<p>4.     Heard on 29.03.2010. Appellant present. Nobody has appeared for the<br \/>\nCantonment Board. However, a fax message dated 26.3.2010 has been received from the<br \/>\nCPIO to say that he has not received a copy of the appeal memo filed by the appellant<br \/>\nand has requested for supply of the same.\n<\/p>\n<p> 5.     I have heard the appellant and also carefully gone through the appeal memo filed<br \/>\nby him. It is his say that as asked by the CPIO, he deposited fee of Rs.2\/- on 3.6.2009 but<br \/>\nno information has been provided to him. This is a serious matter. Besides, non-<br \/>\nappearance of the CPIO before the Commission on the plea that copy of the appeal memo<br \/>\nhas not been sent to him also does not appear to be justified. It appears to us that there<br \/>\nhas been deliberate and intentional delay on the part of CPIO in supply of information to<br \/>\nthe appellant.\n<\/p>\n<p>                                           DECISION<\/p>\n<p>6.          In view of the above, the following order is passed :-\n<\/p>\n<blockquote><p>     (i)       Shri D.R. Singh, Senior Sanitary Inspector, Cantonment Board, Jabalpur<br \/>\n               (CPIO) is hereby directed to supply the requested information to the appellant<br \/>\n               in 02 weeks time.\n<\/p><\/blockquote>\n<blockquote><p>     (ii)      Notice may be issued to him under section 20(1) of the RTI Act to show cause<br \/>\n               why penal action should not be initiated against him for non-supply of<br \/>\n               information to the appellant so far.\n<\/p><\/blockquote>\n<p>7.      The matter will come up for hearing on 30.4.2010 at 1030 hrs. Shri D.R. Singh<br \/>\nwill personally appear before the Commission to submit his explanation. He may file his<br \/>\nrepresentation two days before the date of hearing with a copy thereof to the appellant.\n<\/p>\n<p>                                                                                         Sd\/-\n<\/p>\n<p>                                                                              ( M.L.
