PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Mr Dabhi, learned APP waives service of notice of Rule on behalf of<br \/>\nthe State.\n<\/p>\n<p>\tThe<br \/>\napplicant prays for regular bail in connection with the offences<br \/>\nregistered as  C.R.No. I-58 of 2011 with Deesa City  Police Station,<br \/>\nDist: Banaskantha  for the offences punishable under sections 306,<br \/>\n498(A) read with Section 114 of Indian Penal Code.\n<\/p>\n<p>\tI<br \/>\nhave heard learned advocate Mr. M.C. Barot for the applicant and Mr<br \/>\nDabhi, learned Additional Public Prosecutor for the respondent &#8211;<br \/>\nState.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the accused &#8211; applicant taking into<br \/>\nconsideration the following aspects:-\n<\/p>\n<p>the<br \/>\n\tmarital life of the applicant- accused with the deceased was about<br \/>\n\tmore than 15 years.\n<\/p>\n<p>Accused<br \/>\n\tapplicant has three minor children aged about 5, 7 and 9<br \/>\n\trespectively.\n<\/p>\n<p>allegations<br \/>\n\tare absolutely general regarding harassment.\n<\/p>\n<p>investigation<br \/>\n\tis over, charge-sheet is filed.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences, couples with the fact that charge-sheet is<br \/>\nfiled, without discussing the evidence in detail, at this stage, I am<br \/>\ninclined to enlarge the applicant on bail  in connection with C.R.No.<br \/>\nI-58 of 2011 registered with Dees Police Station, Dist: Banaskantha<br \/>\nfor the offences punishable under sections 306, 498(A) read with<br \/>\nSection 114 of Indian Penal Code, on furnishing   bond of Rs.15,000\/-<br \/>\n(Rupees Fifteen thousand only)  with one surety of the like amount to<br \/>\nthe satisfaction of the lower Court and on conditions that the<br \/>\napplicant shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nday of English Calender month between  11.00 a.m. and 2 p.m .\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions Judge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail before the Lower Court having<br \/>\n\tjurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
