No.32624 of 2010\n                                  JAGDEO PATHAK\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2   29.10.2010               Heard learned counsel for the petitioner as well<\/p>\n<p>                 as learned counsel for the state assisted by learned counsel<\/p>\n<p>                 for the informant.\n<\/p>\n<p>                             Admittedly, petitioner and informant are own<\/p>\n<p>                 brothers and the allegation against the petitioner is that he<\/p>\n<p>                 sold the share of informant fraudulently. Admittedly, for<\/p>\n<p>                 execution of several sale-deeds, two other cases were filed<\/p>\n<p>                 by the informant apart from the instant case.<\/p>\n<p>                             Learned counsel for the petitioner points out that<\/p>\n<p>                 informant got a fraudulent decree in his favour in title suit<\/p>\n<p>                 No. 191 of 1997 and for setting aside the aforesaid decree,<\/p>\n<p>                 the petitioner has already filed Title Suit in the court of Sub<\/p>\n<p>                 Judge, Buxar, so it is a case of land dispute between the two<\/p>\n<p>                 brothers.\n<\/p>\n<p>                             Considering the aforesaid submissions as well as<\/p>\n<p>                 facts and circumstances of the case, this anticipatory bail<\/p>\n<p>                 petition is allowed. In the event of arrest or surrender before<\/p>\n<p>                 the court of Chief Judicial Magistrate, Buxar within 30 days<\/p>\n<p>                 from the date of receipt of the order, the petitioner, namely,<\/p>\n<p>                 Jagdeo Pathak shall be released on bail on furnishing bail<\/p>\n<p>                 bond of Rs 10,000\/- (ten thousand) with two sureties of the<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        like amount each in connection with Buxar (T) P.S.
