DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing CR No.I &#8211; 270 of 2010 with  Danilimda  Police Station,<br \/>\nfor the offences punishable under Sections  324, 323, 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\t\tLearned counsel<br \/>\nappearing for the applicants submits that  looking to the nature of<br \/>\noffence and the role  attributed to the accused, by imposing suitable<br \/>\nconditions, the applicants may be enlarged on bail.\n<\/p>\n<p>\t\tHeard learned<br \/>\nAPP  for the respondent &#8211; State.  He has submitted that looking<br \/>\nto the nature of offence and the role attributed to the accused, they<br \/>\nmay not be granted bail.\n<\/p>\n<p>3.\t\tHaving heard<br \/>\nlearned counsel for the parties and perusing the record of the case<br \/>\nand considering the  facts and circumstances of the case, by imposing<br \/>\nstrict conditions, the applicants accused can be enlarged on bail for<br \/>\noffences punishable under sections 324, 323 and 114 of IPC.<br \/>\nConsidering all the above aspects,    I am inclined to enlarge the<br \/>\napplicants on bail.\n<\/p>\n<p>4.\t\tIn the facts<br \/>\nand circumstances of the case, the application is allowed and the<br \/>\napplicants are ordered to be released on bail in connection with<br \/>\nfirst information report registered being C.R. No.I- 270 of 2010 with<br \/>\n Danilimda  Police Station, on executing bond of Rs.5,000\/- (Rupees<br \/>\nFive thousand only) each with one surety each of the like amount to<br \/>\nthe satisfaction of the trial Court and subject to the conditions<br \/>\nthat they shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>They<br \/>\n\tshall not enter into the City  limits of Ahmedabad for a<br \/>\n\tperiod of three months.\n<\/p>\n<p>The<br \/>\n\t\t\tAuthorities will release the applicants only if they are not<br \/>\n\t\t\trequired in connection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\t\t\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\t\t\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\t\t\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\t\t\tbond to be executed before the lower court having jurisdiction to<br \/>\n\t\t\ttry the case.\n<\/p>\n<p>At<br \/>\n\t\t\tthe trial, the trial court shall not be influenced by the<br \/>\n\t\t\tobservations of preliminary nature, qua the evidence at this<br \/>\n\t\t\tstage, made by this Court while enlarging the applicant on bail.\n<\/p>\n<p>      Rule is<br \/>\nmade absolute to the aforesaid extent.
