Rajendra Babu, J. <\/p>\n<p>1. The petitioner, a resident of Ward No. 18 of<br \/>\nMuvattupuzha Municipality, filed this O.P. for directing<br \/>\nrespondents 2, 3 and 4 to take immediate steps to prevent<br \/>\nrespondents 6 and 7 from proceeding with the construction<br \/>\nwork of the cemetery in the six cents of property in Marady<br \/>\nvillage for the Brotheren Assembly without obtaining the<br \/>\nlicence or sanction from the concerned authorities.\n<\/p>\n<p>2. Heard the learned counsel for the petitioner,<br \/>\nrespondents 6 to 8 and the learned Govt. Pleader.\n<\/p>\n<p>3. The Bretheren Assembly purchased 6 cents of<br \/>\nproperty by Ext. R6(c) document dt. 11.3.1986 for the<br \/>\npurpose of using it as a graveyard, from the C.S.I. East<br \/>\nKerala Maha Edavaka. the 6 cents of property covered by<br \/>\nEx.R6(c) was part of 1 acre 33 cents of land held by the<br \/>\nC.S.I. Edavaka. The document would reveal that the<br \/>\nproperty was being used as a graveyard for the last several<br \/>\nyears. When respondents 6 and 7 started construction of a<br \/>\ngraveyard consisting of concrete slabs and cells, the<br \/>\npresent petitioners filed this O.P. for directing the<br \/>\nMunicipality to take appropriate steps to prevent the<br \/>\nconstruction of the graveyard without obtaining a licence.\n<\/p>\n<p>4. The main contention put forward by respondents 6<br \/>\nand 7 was that the above land was being used as a graveyard<br \/>\nfor the last several years even prior to the coming into<br \/>\nforce of the Municipalities Act and hence no licence was<br \/>\nnecessary for burial of bodies in the premises and for<br \/>\nconstruction of the graveyard. The learned counsel for the<br \/>\npetitioner submitted that the brother of the petitioner<br \/>\napproached this court by preferring O.P.3864\/86 when the<br \/>\nrespondents started the construction of a burial ground and<br \/>\nthe same was disposed of by this court directing the<br \/>\nauthorities to consider the disputes in accordance with law.<br \/>\nAccordingly the Commissioner of Municipality passed<br \/>\nExt. R6(c) order on 22.8.1992 holding that the burial ground<br \/>\nwas in existence for the last so many years and hence the<br \/>\nbrother of the petitioner was not entitled to any reliefs.<br \/>\nExt.R6(c) order would reveal that the Tahsildar had visited<br \/>\nthe place and filed a report and that the Municipal<br \/>\nCommissioner made a local inspection before passing the<br \/>\norder. The commissioner further held that the above<br \/>\nproperty had been used as a burial ground even prior to the<br \/>\ncoming into force of the Municipalities Act and as such the<br \/>\nobjections raised by the brother of the present petitioner<br \/>\ncould not be sustained and those objections were overruled.\n<\/p>\n<p>5. The learned counsel for the petitioner submitted<br \/>\nthat in view of Section 483 of the Municipality Act, the burial<br \/>\nground has to be registered. The Municipality Act, 1994 has<br \/>\ncome into force after the passing of Ext. R6(c) order by the<br \/>\nMunicipal Commissioner. Section 483 of the present Act (which<br \/>\ncorresponds to Section 320 of the Municipalities Act, 1960)<br \/>\nsays:\n<\/p>\n<p>&#8220;Registration or closing of ownerless places<br \/>\nfor disposal of the dead.- (1) Every owner or<br \/>\nperson having control of any place used at<br \/>\nthe commencement of this Act as a place for<br \/>\nburial, burning, or otherwise disposing, of<br \/>\nthe dead, shall, where such place is not<br \/>\nalready registered, apply to the Municipality<br \/>\nto have such place registered.\n<\/p>\n<p>(2) Where it appears to the<br \/>\nMunicipality that there is no owner or person<br \/>\nhaving control of such place, it shall assume<br \/>\nsuch control and register such place or may,<br \/>\nwith the sanction of the Government, close<br \/>\nit.&#8221;\n<\/p>\n<p>In view of Section 483 of the Act, even if the above burial<br \/>\nground was in existence even prior to the coming into force<br \/>\nof the Act, it requires registration. So far as the new<br \/>\nplaces for disposal of dead bodies are concerned, Section 484<br \/>\nmandate that a licence should be obtained from the<br \/>\nmunicipality. The object of the above provisions are to<br \/>\nregulate and control the disposal of dead bodies in such a<br \/>\nmanner that it should not cause nuisance to the nearby<br \/>\ninhabitants. In view of Section 483 of the present Act,<br \/>\nrespondents 6 and 7 should obtain registration from the<br \/>\nmunicipality for the use of the above areas for the disposal<br \/>\nof the dead bodies.\n<\/p>\n<p>6. The learned Govt. Pleader filed a memo with the report obtained from the District Medical Officer of Health.<br \/>\nIt is in evidence that respondents 6 and 7 are constructing a<br \/>\ncemetery. The medical officer has visited the place and<br \/>\nfiled the above report which says that the respondents have<br \/>\nalready made a pit of 4.4 metres length, 2.75 metres width<br \/>\nand 3 1\/2 metres depth recently towards the middle of the six<br \/>\ncents of property. The above pit was separated with three<br \/>\ncross walls forming four separate cells and the pit was made<br \/>\nof cement bricks plastered with cement concrete. There are<br \/>\neight concrete slabs thus made and the cells are covered with<br \/>\nit. The report of the medical officer shows that from public<br \/>\nhealth point of view, the above site is not suitable for<br \/>\nburial ground and that any development or extension of the<br \/>\nburial ground should be done only with the permission of the<br \/>\nauthorities concerned. The report of the environmental<br \/>\nengineer of the State Pollution Control Board also was<br \/>\nproduced by the standing counsel for the Kerala State<br \/>\nPollution Control Board. The engineer also visited the place<br \/>\nand reported that a pit was constructed with four<br \/>\ncompartments, each of about 3.5 metres depth and 75<br \/>\ncentimetres width and 2 metres length and the compartments<br \/>\nhad their walls plastered, but the bottom was open and<br \/>\nconcrete slabs were made for covering the top. The<br \/>\npetitioner&#8217;s house was nearly 40 metres away from the above<br \/>\nsite and within 100 metres of radius there were some other<br \/>\nhouses. The area was hilly with steep slopes. It was<br \/>\nfurther noticed that being a rocky area, the depth of the<br \/>\nsoil was between one metre to two metres and if burial of<br \/>\ndead bodies are done in the proposed site, there is chance of<br \/>\nsweepage and consequent pollution of water in the well. In<br \/>\nview of the report of the Health Officer and the Engineer of<br \/>\nthe Pollution Control Board, the municipality has to examine<br \/>\nwhether such a cemetery can be allowed to be constructed in<br \/>\nthat hilly area, which was likely to cause pollution to the<br \/>\nwater in the nearby wells. Being an old graveyard, it is<br \/>\ntrue that a licence may not be required for using that place<br \/>\nas a burial ground as it was used. But in the nature of the<br \/>\nnew constructions made by respondents 6 and 7, it is for the<br \/>\nconcerned municipality to ascertain whether the use of the<br \/>\nabove burial ground in the manner in which the respondents<br \/>\nhave now proposed to use would affect the health of the<br \/>\ninhabitants by polluting the water. That is a matter which<br \/>\nthe municipality will have to consider and make suitable<br \/>\ndirections for avoiding the pollution. What steps the<br \/>\nmunicipality has to take is a matter for them to decide in<br \/>\nconsultation with the concerned experts. Hence the<br \/>\nconstruction of the cemetery as proposed will have to be<br \/>\nregulated by the municipality. Regarding the use of tat<br \/>\narea as a graveyard or a burial ground, licence from the<br \/>\nmunicipality is not necessary and respondents 6 and 7 are<br \/>\nentitled to use that area as a burial ground. But the manner<br \/>\nin which the area has to be used should be as per the<br \/>\ndirections of the municipal authorities and it should not<br \/>\ncreate any problems to the health of the nearby inhabitants<br \/>\nby polluting the underground water.\n<\/p>\n<p>7. In the result this O.P. is allowed in part.<br \/>\nRespondents 6 and 7 shall get the above burial ground<br \/>\nregistered before the municipal authorities in accordance<br \/>\nwith Section 483 of the Municipality Act. Further, the<br \/>\nconstruction of the cemetery shall be in accordance with the<br \/>\ndirections to be obtained from the municipal authorities.<br \/>\nThe construction of the cemetery shall not in any way cause<br \/>\npollution to the water of the nearby wells.
