The petitioners have challenged the order dated 10th October,<\/p>\n<p>2006, passed by the Central Administrative Tribunal, Principal<\/p>\n<p>Bench, New Delhi in OA No.258\/2005 titled as \u201eConstable (DVR)<\/p>\n<p>Ashok Kumar v. Government of NCT of Delhi &amp; Ors.\u201f, directing the<\/p>\n<p>petitioners to grant the relief of 50% of the salary to the respondent<\/p>\n<p>for the period of 14th May, 1991 to 2nd October, 2002 and also in<\/p>\n<p><span class=\"hidden_text\">WP(C) No.340\/2007                                             Page 1 of 5<\/span><br \/>\n granting the full salary for the period of 3rd October , 2002 to 9th<\/p>\n<p>June, 2003, if not already paid, after deducting the subsistence<\/p>\n<p>allowance, if any paid. The original application had been filed by the<\/p>\n<p>respondent seeking the quashing and setting aside of the appellate<\/p>\n<p>authority order dated 25th February, 2004 whereby one year of<\/p>\n<p>approved service of the respondent was forfeited with consequential<\/p>\n<p>benefits in terms of seniority, promotion etc.<\/p>\n<p>2.    The punishment was imposed on the respondent pursuant to a<\/p>\n<p>departmental enquiry on the charge that while being posted in 1st Bn<\/p>\n<p>DAP he was detailed for duty with Govt. vehicle No. DEG 4996 at PTS<\/p>\n<p>Jharoda Kalan, New Delhi for transportation of force for Ram Lila<\/p>\n<p>and VVIP duty at Rashtrapati Bhawan, etc on 22.09.1990 with the<\/p>\n<p>direction to remain there till further orders. However, the respondent<\/p>\n<p>came back along with his vehicle on 23.09.1990 from PTS, Jharoda<\/p>\n<p>Kalan, New Delhi at his own sweet will. When the matter was<\/p>\n<p>reported that the respondent has returned from duty, Inspector<\/p>\n<p>Balbir Singh asked the respondent as to why he had come back<\/p>\n<p>pursuant to which the respondent replied &#8220;MAINE KYA THEKA LE<\/p>\n<p>RAKHA HAI AUR BHI DRIVER HAIN&#8221;. The respondent thereafter had<\/p>\n<p>refused to go back to PTS for duty and a report to this effect was<\/p>\n<p>lodged vide DD No 38-B dated 23th September, 1990 DAP, Control<\/p>\n<p><span class=\"hidden_text\">WP(C) No.340\/2007                                            Page 2 of 5<\/span><br \/>\n Room. Allegations were made against the respondent for having<\/p>\n<p>remained absent willfully and unauthorizedly on previous two<\/p>\n<p>occasions. The respondent had also absented himself previously on<\/p>\n<p>six occasions and had been awarded PDs\/WP etc.<\/p>\n<p>3.    The pleas and contentions of the respondent were considered<\/p>\n<p>by the Tribunal in detail and after due consideration the Tribunal<\/p>\n<p>held that there were no grounds to interfere with the decision of the<\/p>\n<p>petitioners   with   regard   to   the   punishment   imposed   on      the<\/p>\n<p>respondent.\n<\/p>\n<\/p>\n<p>4.    However, regarding the issue relating to the treatment of the<\/p>\n<p>period of the respondent\u201fs absence, which had been treated as not<\/p>\n<p>spent on duty, the Tribunal had noted that although the appellate<\/p>\n<p>authority had modified the substantive punishment of forfeiture of<\/p>\n<p>approved service permanently from three years to one year, it did not<\/p>\n<p>however record any specific decision relating to the period of<\/p>\n<p>dismissal, suspension etc. In the circumstances, the Tribunal had<\/p>\n<p>held that the decision of the petitioners to award the reduced<\/p>\n<p>punishment of forfeiture of one year approved service permanently is<\/p>\n<p>not interfered with in the interest of maintenance of discipline in the<\/p>\n<p>police force. However, the Tribunal took note of the fact that the<\/p>\n<p><span class=\"hidden_text\">WP(C) No.340\/2007                                               Page 3 of 5<\/span><br \/>\n respondent should not be denied the relief in terms of the treatment<\/p>\n<p>of his period of absence, since it was largely due to prolonged legal<\/p>\n<p>proceedings, for which he could not be held responsible. Therefore,<\/p>\n<p>the Tribunal had directed the petitioners to pay 50% of the salary to<\/p>\n<p>the respondent for the period 14.05.1991 to 2.10.2002. Since for the<\/p>\n<p>period of suspension the respondent had been subsequently<\/p>\n<p>reinstated, it was held that he would be entitled to full salary for the<\/p>\n<p>period from 3.10.2002 to 9.6.2003 if the amount was not already<\/p>\n<p>paid, after deducting the subsistence allowance, if any paid to the<\/p>\n<p>respondent. It is this relief that has been challenged by the<\/p>\n<p>petitioners in the present writ petition.\n<\/p>\n<\/p>\n<p>5.     The matter had been taken up for hearing on 4th July, 2011,<\/p>\n<p>however, no one had appeared on behalf of the petitioners, but no<\/p>\n<p>adverse order was passed against the petitioners in the interest of<\/p>\n<p>justice and the matter was allowed to remain on board in the<\/p>\n<p>category of \u201eRegular Matters\u201f.\n<\/p>\n<\/p>\n<p>6.    Today, again no one is present on behalf of the petitioners. In<\/p>\n<p>the circumstances, we are constrained to dismiss the writ petition in<\/p>\n<p>default for non appearance of the petitioners and their counsel.
