MAJMUDAR for the\nopponent \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\t\tRule.\n<\/p>\n<p>Learned advocate Mr. Majmudar waives service of notice for the<br \/>\nopponent.\n<\/p>\n<p>\t\tWith<br \/>\nthe consent of the parties, this application is taken up for final<br \/>\nhearing.\n<\/p>\n<p>\t\tHeard<br \/>\nlearned advocates for the parties at length and in great detail.\n<\/p>\n<p>\t\tThe<br \/>\napplicant has sought stay of the judgement and order passed by the<br \/>\ntrial Court and confirmed by the first appellate Court. It appears<br \/>\nthat  termination order of the applicant was set aside and the<br \/>\nopponent was found to be entitled for wages and other benefits as an<br \/>\nemployee from 2.2.1985. It is not in dispute that the opponent has<br \/>\nreached  the age of superannuation and is no longer in service of the<br \/>\napplicant. Therefore, there is no question of stay of the orders<br \/>\npassed by the Court below with regard to his employment. However, in<br \/>\nview of the fact that money decree is passed in favour of the<br \/>\nopponent with regard to wages and other benefits from 2.2.1985, the<br \/>\ndecree being money decree, it cannot be stayed. Therefore, the<br \/>\napplicant is directed to deposit the decretal amount in the trial<br \/>\nCourt within a period of four weeks from today and the opponent is at<br \/>\nliberty to withdraw the same on giving an undertaking before the<br \/>\nCourt that he shall refund the same to the applicant in case the<br \/>\napplicant succeeds in Second Appeal No. 242 of 2010.\n<\/p>\n<p>\t\tWith<br \/>\nthe above directions, the Civil Application stands disposed of. Rule<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>  (BANKIM N.
