SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 13\/10\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\tBy<br \/>\nway of the present petition the petitioner has prayed to direct the<br \/>\nrespondent no. 4 to decide the statutory complaint of the present<br \/>\npetitioner dated 04.02.2005 at the earliest and preferably within a<br \/>\nperiod of one month.\n<\/p>\n<p>2.\tThis<br \/>\nCourt vide interim order dated 22.07.2005 observed as under:\n<\/p>\n<p>&#8220;Notice<br \/>\nreturnable on August 17, 2005.  Shri Jitendra Malkan, learned<br \/>\nAssistant Solicitor General of India waives service of notice on<br \/>\nbehalf of Respondents no. 1,2 and 4.  By Court order dated January<br \/>\n24, 2005 passed in Special Civil Application No. 6356 of 2004,<br \/>\ncompetent authority has been directed to dispose of statutory appeal<br \/>\npreferred by the petitioner Manojkumar Gupta within a period of four<br \/>\nmonths from its receipt.  This period is over but the appeal has not<br \/>\nbeen decided.  Consequently, this petition has been filed directing<br \/>\nthe respondents to decide the appeal.  Therefore, respondents will<br \/>\ndecide the appeal and place order along with reply in this case.  It<br \/>\nis made clear that the filing of this petition will not prevent the<br \/>\ncompetent authority from disposing of the appeal.  Post the matter on<br \/>\nAugust 17, 2005.&#8221;\n<\/p>\n<p>3.\tIn<br \/>\nview of the above order and the relief prayed for, it appears that<br \/>\nthe petition has become academic.  Petition, therefore, stands<br \/>\ndisposed of as having become academic.
